Public Accounts Committee: Business of Committee (8 Nov 2018)

Marc MacSharry: As it has a lot more correspondence than we do, it will know a lot more about it.

Public Accounts Committee: Business of Committee (8 Nov 2018)

Marc MacSharry: As it will know a lot more than us, I would not worry about it.

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Marc MacSharry: I welcome the witnesses. Who in the State Claims Agency directs a case? If I am taking a case, I brief my solicitor on the outcome I would like to achieve. Who in the State Claims Agency does this?

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Marc MacSharry: When a case ends up with the State Claims Agency, is the agency briefed by the Department or the Minister or is its only modus operandito protect the State and minimise exposure?

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Marc MacSharry: Or a Minister, if the action is being taken against him or her or any of the State agencies within his or her remit.

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Marc MacSharry: Is being under case management different from being in court? I do not know the legalese.

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Marc MacSharry: When Mr. Breen says "in court", he is not including that process.

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Marc MacSharry: In the room?

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Marc MacSharry: With regard to litigation, Mr. Breen would not associate discovery as being in court.

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)

Marc MacSharry: I am maybe not as up to date on the thalidomide issue as some other members. An offer of €62,500 was made. Had Mr. Breen a different role in the State Claims Agency at that point?

Public Accounts Committee: Matters related to Medical Negligence, Open Disclosure, Cervical Cancer and Thalidomide Litigation (8 Nov 2018)
