Chapter 13 - Guardian Ad Litem Follow-up Report
(27 Oct 2022)

Colm Burke: I fully understand that much of this is not easy. In relation to people who go through the facility, has there ever been an assessment of the people who have left? For example, as regards those who left five years ago, has a full assessment been done of whether the facility was of benefit to them in real terms? We are talking about over 260 staff. This matter was dealt with in the...

Colm Burke: Why wait? If we are spending that kind of money and we have that number of staff employed, why will it take until 2024 to come back with the results?

Public Accounts Committee: 2021 Report of the Comptroller and Auditor General and Appropriation Accounts

Chapter 13 - Guardian Ad Litem Follow-up Report
(27 Oct 2022)

Colm Burke: I know the Cork Life Centre does not come under the remit of the Department. It provides young people who have dropped out of school with a structured education. The funding provided for it is under €200,000 for 50 children. In the case of Oberstown, €24 million is being spent on 46 children. Do we need to look at a better way of approaching this in a more structured way? I...

Chapter 13 - Guardian Ad Litem Follow-up Report
(27 Oct 2022)

Colm Burke: I am saying that many of the support mechanisms that are out there need funding, in particular the one with which I was involved in Blackpool in Cork. It was set up by a number of people voluntarily and they eventually got State funding. To this day, it provides support to approximately 50 people.

Chapter 13 - Guardian Ad Litem Follow-up Report
(27 Oct 2022)

Colm Burke: Is it not the case that young people are dropping out of the educational system and getting into difficulties in particular areas? Do we need to step in at a faster rate rather than waiting for someone else on the ground to do it? One of the problems arising for many young people is that it is too late before anyone steps in.

Chapter 13 - Guardian Ad Litem Follow-up Report
(27 Oct 2022)

Colm Burke: The problem with the Cork Life Centre is that the centre is under the education and training board, ETB. It is not getting funding and may very well close. We have 50 children. It now technically comes under the Department in the sense that we have vulnerable young people who are going to be out there without any support mechanisms and we are getting less than €200,000 per annum....

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: I am probably coming to this from a different angle. Having looked at similar projects abroad, there are two issues. One is that the main infrastructure has now been built and there is a major issue regarding disputes between the contractors and the project team. However, one of the issues that is out of the way relates to the substantial increase in building costs. We are lucky that the...

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: I accept that, but I am worried about the fact that they have all been parked. I accept that the reason for this is in order that those involved can get on with the project. If everything has been parked, I am obliged to wonder when we will get the final figure. Will it be in 12 months, two years or five years? Some of these disputes can go on for quite some time.

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: That may well be.

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: I have dealt with building contractors in relation to the project in Canada. It was interesting that they had decided the project was going to take so much time and had actually built in 15% increased costs per annum as the project was developing. They started their project in 2019 and it was a five year project. The 15% increase per annum was a huge increase. The project is also a...

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: We might get some clarification regarding the pending claims. What are the pending claims outstanding? I am not saying they can say that we are liable for this amount but what is actually outstanding that it is still not resolved?

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: And outstanding claims as regards-----

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: Even at the end of that letter, it is saying that this excluded any third party costs that may arise. Are they still pending? The other issue is, I presume a lot of these cases would be dealt with by the Chief State Solicitor's office or the Attorney General's office. The work may have been farmed out to private legal practices but surely we should have an idea of what is actually...

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: I am not sure.

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: Would the State Claims Agency be able to give us the information?

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: Can I raise one issue on that?

Public Accounts Committee: Business of Committee (27 Oct 2022)

Colm Burke: It is regarding the employment of people who provide home tuition. They are paid by the Department of Education but are regarded as self-employed. Even though they are classified as self-employed, if they put money into a pension it is not tax-deductible. They are having serious problems as regards what they can and cannot do. While the money is paid to them to by the Department of...
