- Safety, Health and Welfare at Work Bill 2004: Report Stage (Resumed). (26 Apr 2005)
Arthur Morgan: I move amendment No. 25: In page 37, between lines 9 and 10, to insert the following: "(f) harassment by way of abuse of any provision contained in this Act.". This amendment would offer some protection to employees from any malicious employers who, for example, chose to abuse the provisions for the testing of alcohol and intoxicants. Given that workers are already considerably exposed to...
- Safety, Health and Welfare at Work Bill 2004: Report Stage (Resumed). (26 Apr 2005)
Arthur Morgan: I accept there are some general protections afforded to employees in subsection (1) but they are insufficiently specific. This amendment gives a very specific balance to the Bill, in particular to section 13(c). I accept the generality of subsection (1) and do not mean to criticise it, except to say that it is insufficiently specific with regard to something as broad as section 13(c). It is...
- Safety, Health and Welfare at Work Bill 2004: Report Stage (Resumed). (26 Apr 2005)
Arthur Morgan: We are going nowhere with this amendment. I thought that including the term "harassment" would have been quite specific and clear and that the Bill required that level of clarity. The Minister of State disagrees with my argument so we must rest the matter.

Arthur Morgan: It nearly is.
- Social and Affordable Housing: Motion (Resumed). (20 Apr 2005)
Arthur Morgan: I will restrict my comments to the issues of social and affordable housing and Government inaction on house prices. I will be restricted further in addressing them as it would take all week to discuss them fully. The Government's strategy to tackle the housing crisis which has affected the State for the best part of the last decade is based on the laissez-faire theory that the market will...
- Garda Síochána Bill 2004 [Seanad]: Second Stage (Resumed). (20 Apr 2005)
Arthur Morgan: My colleague, Deputy à Snodaigh, stated Sinn Féin's view of the existing case for fundamental Garda reform and welcomed on behalf of our party the opportunity to comment on this long-overdue, if flawed, Garda reform legislation. Deputy Crowe addressed the need to replace the Minister's proposed ombudsman commission with a single Garda ombudsman with equal powers to that in the Six Counties...
- Work Permits. (20 Apr 2005)
Arthur Morgan: Does the Minister agree that the current system is designed to disempower migrant workers and facilitate their exploitation by employers or at least has that effect? Does the Minister also agree that a migrant worker, a person in a foreign land who probably has some language difficulties and whose ability to remain here is dependent on the employer who holds his or her work permit, is much...
- Work Permits. (20 Apr 2005)
Arthur Morgan: One of the reasons I have raised this issue on several occasions is to try to have it included in the provisions of the new Bill. Does the Minister accept that if it is not dealt with comprehensively within the Bill, the legislation will be considerably weakened? I look forward with interest to the publication of the Bill and wish it speedy progress. In light of the reticence on the inclusion...
- Work Permits. (20 Apr 2005)
Arthur Morgan: Can the Minister not do that at present?
- Work Permits. (20 Apr 2005)
Arthur Morgan: Is that the case?
- Work Permits. (20 Apr 2005)
Arthur Morgan: These numbers are modest. Will the Minister accept that if a much-needed worker is granted a permit, it is then reasonable that he or she should not be separated from his or her partner? In most Irish families, both parents work to maintain the household. These permit workers are no different. Is it not fair that they should be offered the opportunity for their spouses to work?
- Work Permits. (20 Apr 2005)
Arthur Morgan: I accept this.

Arthur Morgan: The numbers are very small.
- Work Permits. (20 Apr 2005)
Arthur Morgan: The point is that the numbers of workers from outside the EU are small.
