Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: Go raibh míle maith agat.

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: Tá an-díoma orm an freagra sin a fháil, ach tógaim ar bord an méid atá ráite ag an Aire Stáit. Cé gur Bille teoranta é, is leasú teoranta a bheadh i gceist anseo agus ní dóigh liom go gcuirfeadh sé as do aon rud. Bheadh muinín agam as an Aire Stáit, go gcuirfeadh sé san áireamh é agus go dtógfadh sé ar bord é. Ach ní bheadh an oiread muinín agam go nglacfaí le...

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: D'éist mé go cúramach leis an méid a bhí le rá ag an Aire Stáit. Cé go bhfáiltím roimh a fhreagra, tháinig "mair, a chapaill, agus gheobhair féar" chugam nuair a d'éist mé leis. Tá sé suntasach gur ardaigh sé ceist Oifig an Choimisinéara Teanga. Is mar gheall ar an dea-obair atá ar bun ag an oifig sin go bhfuil an foráil seo á moladh againn. Tá a fhios ag an Aire...

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: I move amendment No. 4: In page 10, before section 5, to insert the following new section: ?5.?The Commission may appoint such and so many persons to be members of the staff of the Commission (an adequate number of whom should be competent in the Irish language so as to provide service through Irish as well as English) as it may determine with the consent of the Minister and the Minister...

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: Sa leasú sin, bhí muid ag moladh go ndéanfar "aon aistriúcháin den sórt sin arna gcur i gcrích ag duine seachas an Coimisiún a tharchur chuig an gCoimisiún lena mbreithniú agus lena gceadú" agus nach bhfoilseofar "na haistriúcháin sin go dtí cibé tráth a bheidh ceadú i dtaobh an aistriúcháin deonaithe ag an gCoimisiún". D'aontaigh mé leis an Aire Stáit an lá faoi...

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: On a point of clarification, can the amendments be resubmitted or may we have leave to submit amendments on Report Stage considering that these amendments have been ruled out of order at this late stage?

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: We should, therefore, be allowed to submit similar amendments on Report Stage to allow us to raise the point regarding Bills being translated into Irish.

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: I accept that. I do not mean to be argumentative, but this is a valid and important point that has been raised with us by the Irish language community.

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: That argument does not stand up. In fairness, the argument being made by the Acting Chairman does not make sense in view of what the Minister of State said last week. We are very unhappy with the ruling made by the Chair. This is not a democratic way of dealing with the issue. We should at least be given leave to debate the amendment in question.

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: Ar phointe oird, sílim gur í an cheist atá á chur ag an Seanadóir ná: An mbeidh seans againn labhairt "on the section" maidir leis an ábhar seo? An bhfuil sé sin ceart go leor?

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: Tá iontas orm gur rialaíodh na leasuithe as ord, ach glacaim le rialú an chathaoirligh. Baineann an bun cheist anseo le cearta teanga, cearta na Gaeilge agus cearta na Gaeltachta agus an dea shampla atá muid in ainm agus a bheith ag léiriú anseo i dTithe an Oireachtais ó thaobh úsáid na Gaeilge de. Tá sé ráite agam cheana go molaim an tAire Stáit faoi an Bille seo a thabhairt...

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: On a point of order, we were not notified of this in advance. Ní bhfuair muid aon scéal go raibh sé seo le tarlú. Go hiondúil, faigheann muid rabhadh má tá rud rialaithe as ord. We are normally given notification and I seek clarification as to why the amendments were ruled out of order.

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: I dispute that and would like to hear what the Minister of State has to say on the issue. It has been said that this Bill will centralise the translation facilities within the Houses of the Oireachtas and that staff are available. I would contend that no additional resources are needed for the Bills to be translated because it is obvious that the staff have already been brought over from...

Seanad: Houses of the Oireachtas Commission (Amendment) Bill 2012: Committee and Remaining Stages (16 Oct 2012)

Trevor Ó Clochartaigh: I will seek leave to resubmit the amendments on Report Stage, which is only fair. The whole case being made by the Minister of State last week was that we are rationalising the translation facilities under the Houses of the Oireachtas Commission. He said that a number of translators had moved from the Department to the Houses of the Oireachtas and that they would be doing the ongoing...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Second Stage (11 Oct 2012)

Trevor Ó Clochartaigh: Tá céad fáilte roimh an Aire Stáit. Bille iontach tábhachtach é seo agus tá sé thar a bheith tábhachtach go mbeimis á phlé. Is léir, ó gach taobh an Tí, go bhfuil géarghá dul i ngleic leis an deacracht seo atá ag cur bac le dul chun cinn cúrsaí gnó ar fud an oileáin. Is maith liom go bhfuil deis againn cur leis an díospóireacht seo. There is no doubt there is a need...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Second Stage (11 Oct 2012)

Trevor Ó Clochartaigh: It alludes to the issue of creating jobs and is a source for debate. Some of the proposals relate to the cost of rents, while another proposes to abolish upward-only rent reviews. Upward-only rent review leases are one of the leading problems faced by businesses. These businesses are locked into contracts with rents fixed at boom time levels. This is despite the subsequent 50% drop in...

Seanad: Order of Business (11 Oct 2012)

Trevor Ó Clochartaigh: We have had a number of calls in recent weeks for a debate on suicide. I am very disturbed because I have spoken this morning to a man who has told me he is suicidal. The reason is that he is an asylum seeker in Lisbrook House, a direct provision hostel in Galway, and a decision was taken yesterday to close the centre. I do not doubt that he is genuinely morose. The Lisbrook centre is...

Joint Oireachtas Committee on Public Service Oversight and Petitions: Office of the Ombudsman Annual Report 2011: Discussion with the Ombudsman (10 Oct 2012)

Trevor Ó Clochartaigh: Has the Ombudsman engaged with any Department or Minister on the proposed amalgamation of the Office of the Ombudsman, An Coimisinéir Teanga and the Ombudsman for Children? I have raised the issue of the Official Languages Act with the Office of the Ombudsman. It has been brought to my attention that the Ombudsman has done a huge amount of work on the issue and very little fault is to...

Joint Oireachtas Committee on Public Service Oversight and Petitions: Office of the Ombudsman Annual Report 2011: Discussion with the Ombudsman (10 Oct 2012)

Trevor Ó Clochartaigh: At any stage.

Joint Oireachtas Committee on Public Service Oversight and Petitions: Office of the Ombudsman Annual Report 2011: Discussion with the Ombudsman (10 Oct 2012)

Trevor Ó Clochartaigh: A great big kite.
