- Sea-Fisheries and Maritime Jurisdiction Bill 2005: Second Stage (Resumed). (24 Nov 2005)
Jim O'Keeffe: Yesterday in Galway Circuit Court a fisherman was charged with fishing over the quota to the value of â¬2,000. He was duly fined â¬5,000, but the penalty did not stop there because that offence attracts an automatic confiscation of the catch and gear. That is where the real penalty arose. His catch and gear were valued at â¬19,000. On paper, that fisherman was fined, quite properly, a sum...

- Order of Business. (24 Nov 2005)
Jim O'Keeffe: I wish to make a point before this gets out of hand. Will the Ceann Comhairle accept there is historic precedent whereby the Ceann Comhairle has flexibility, particularly on matters raised on Thursday mornings? I suggest the Ceann Comhairle uses that flexibility and does not have the Minister sitting mute. A simple reply will solve the problem.

- Adequacy of Law. (23 Nov 2005)
Jim O'Keeffe: I take it from the Minister's reply that he feels that the balance provided by the 1997 Act is the correct balance. The law needs to be rebalanced and the pendulum needs to be swung more in favour of the home owner who has to face an intruder, perhaps in very difficult circumstances. I am not referring to a recent major case but am talking about the general issue. There are approximately...
- Adequacy of Law. (23 Nov 2005)
Jim O'Keeffe: Unlike the Minister, I will not refer to that recent case. Nobody wants a situation to pertain where people can be killed with impunity. I will rise to the challenge the Minister has set. He is satisfied with the law as it stands but has suggested that if I come forward with a specific proposition, he will do as I have done with regard to some of this proposals, that is, if I find them...
- Prison Building Programme. (23 Nov 2005)
Jim O'Keeffe: There are two issues on the value. Clearly the Minister has no clue about land values. Anyone who does not realise that five acres which is zoned for building has enormous value as opposed to agricultural land that is unzoned realises nothing. Incidentally, the five acres was originally supposed to be included and at the last minute it was excluded. This farm was the dearest farm in Europe....

Jim O'Keeffe: Do not rush it. Do not throw away taxpayers' money again.
- Road Traffic Offences. (23 Nov 2005)
Jim O'Keeffe: I appreciate the Minister does not want to interfere in individual cases but an important point arises here. Were the cases in question dismissed without prejudice? Is this the end of the matter or are they going to the High Court? Does the Minister agree that in the main it would not be interfering with court proceedings for this House and the Minister to send a message that any reasonable...

Jim O'Keeffe: What if a request was reasonable?
- Prison Building Programme. (23 Nov 2005)
Jim O'Keeffe: The Minister stated the capital cost of the project would be between â¬200 million and â¬300 million. Did he come up with this figure off the top of his head or has he received expert advice? Perhaps he received more advice than when he purchased the site.
- Prison Building Programme. (23 Nov 2005)
Jim O'Keeffe: How much will the associated project, the relocation of the Central Mental Hospital to the same campus, cost? The Minister is giving himself a significant timeframe of between two and six years to complete the project. Can he give a more accurate timeframe?
