Road Traffic Bill 2006 [Seanad]: Second Stage (Resumed). (20 Jun 2006)

Seán Fleming: I welcome the opportunity of speaking on the Road Traffic Bill 2006 and propose to highlight some of its key features. The Bill facilitates the introduction of mandatory roadside breath tests for drivers for alcohol in a targeted manner and provides for the introduction on a statutory basis of control of the use of mobile telephones and in-vehicle communication equipment by occupants of motor...

Criminal Justice (Mutual Assistance) Bill 2005 [Seanad]: Second Stage. (8 Jun 2006)

Seán Fleming: I welcome the opportunity to speak on the Criminal Justice (Mutual Assistance) Bill 2005. I understand that this Bill has already been discussed in the Seanad and is now coming before this House for discussion on Second Stage. There already have been some improvements and refinements to the Bill following discussion in the Seanad, and I am sure there will be more before this Bill is enacted....

Criminal Justice (Mutual Assistance) Bill 2005 [Seanad]: Second Stage. (8 Jun 2006)

Seán Fleming: Exactly. Once he got over the boundary he was safe as there was no FBI to get him. It was great entertainment but a ridiculous way to catch criminals. In effect, that is what we have here. Once a criminal goes from one jurisdiction to another, he or she is free unless international agreements pin him or her down and make him or her face the penalties for his or her crime. We are only...

Planning and Development (Strategic Infrastructure) Bill 2006 [Seanad]: Second Stage (Resumed). (25 May 2006)

Seán Fleming: This presents an opportunity to speak on the general point of how the population has grown in recent times. Inevitably, in a strong economy, the need for facilities increases considerably. Until now, it has not been possible for infrastructure such as motorways, roads and power facilities to keep up with the requirements of the general public. People feel the Government or local authorities...

Planning and Development (Strategic Infrastructure) Bill 2006 [Seanad]: Second Stage (Resumed). (25 May 2006)

Seán Fleming: Yes, it is long overdue. There was previously provision but too much responsibility on the local authority. The onus now falls on the planning applicant to prove his or her bona fides, as is only right. That is good news buried in this important legislation. It is a special section not directly connected with the legislation's main business, but I wish to highlight it from that perspective....

Electoral Registration Commissioner Bill 2005: Second Stage (Resumed). (26 Apr 2006)

Seán Fleming: I welcome the opportunity to contribute to the debate. Like Deputy O'Connor, I thank Deputy Gilmore for introducing the Bill. I agree with the principle but disagree with the commissioner aspect. As I was a first-time candidate when elected in 1997, I can be far more direct than Deputy O'Connor was. The registers are a disgrace and an outrage. They are inaccurate and would not be tolerated by...

Electoral Registration Commissioner Bill 2005: Second Stage (Resumed). (26 Apr 2006)

Seán Fleming: I support the principle but not the idea of a commissioner. I would prefer to see it controlled through this House rather than by an independent commissioner. I believe Deputy Gilmore is right. That we should not be tampering with the electoral system by putting one side of the House in opposition to the other is exactly the point I was making.

Electoral Registration Commissioner Bill 2005: Second Stage (Resumed). (26 Apr 2006)

Seán Fleming: There should be an all-party agreement. I would like the Joint Committee on Environment and Local Government, or a similar body, to come up with an all-party agreement. I think such an move would receive the support of both sides of the House. That is how I would like us to proceed.
