Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (Resumed) and Remaining Stages (29 May 2013)

Seán Fleming: The Minister has just indicated that the workers and unions involved in such agreements would know but that is a current arrangement. The Minister knows that as part of the failed Croke Park II agreement, at least ten letters were issued by the Minister's Department and line management as letters of comfort to individual trade unions. Those were never made public and although I asked the...

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (Resumed) and Remaining Stages (29 May 2013)

Seán Fleming: I move amendment No. 21:In page 6, line 26, column 1, after "€185,000" to insert "but not over €200,000".

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (Resumed) and Remaining Stages (29 May 2013)

Seán Fleming: I move amendment No. 24: In page 6, between lines 26 and 27, to insert the following: " Any amount over €200,000 20 per cent "

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (Resumed) and Remaining Stages (29 May 2013)

Seán Fleming: I move amendment No. 28:In page 6, line 35, after "may," to insert "by way of regulation by the Minister".This is the nasty section of the legislation where the Minister is introducing a power to himself or to Ministers to make amendments less favourable in terms of remuneration of persons in respect of employment in the public service and also to provide for changes to their working time,...

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (Resumed) and Remaining Stages (29 May 2013)

Seán Fleming: I would be happy if the collective agreements reached under the auspices of the Labour Relations Commission could be made public.

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (29 May 2013)

Seán Fleming: There is a group of amendments here and I am in the unusual position where the amendment I drafted is close enough, but not identical, to that of Deputy Boyd Barrett. It is the same principle. Essentially, I want to amend the table on page 6 of the Bill along the general lines about which Deputy Boyd Barrett spoke and my amendment reflects that. My amendments, amendments Nos. 21 and 24,...

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (29 May 2013)

Seán Fleming: I move amendment No. 6:In page 5, line 5, after “salary,” to insert “excluding overtime payments”.This is very straightforward. There are a number of amendments to the section but this amendment is not grouped for discussion. It deals with the reference to annual remuneration. I have asked for it to be included so there is no doubt that overtime payments will in...

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (29 May 2013)

Seán Fleming: I understand the Minister's remarks and I hope everyone is listening. If this ever goes for adjudication, the remarks on the record of the House will be used to buttress the point and the concern I was raising. My main concern is that because of the changes in the public service and the nature of pay, overtime could become fixed in some circumstances down the road. I will take the...

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (29 May 2013)

Seán Fleming: On a point of information, I contacted the Bills Office during the suspension and it has now provided to Members a list of the amendments that are deemed to be in order. Some 52 of the 71 amendments tabled have been ruled out of order and the other 19 can be discussed. Perhaps the Standing Orders of the House might be changed in order that, in addition to grouping schedules, lists of...

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (29 May 2013)

Seán Fleming: On a point of order-----

Financial Emergency Measures in the Public Interest Bill 2013: Committee Stage (29 May 2013)

Seán Fleming: We are here to consider Committee Stage of legislation. I submitted 20 amendments, of which 12 were ruled out of order. The Deputy behind mentioned that 24 of his 25 amendments were ruled out of order as, I suspect, were the majority of the 71 tabled amendments. It would be helpful to us if, through the Office of the Ceann Comhairle, a list could be presented to us of the amendments that...

Written Answers — Department of Health: Hospital Appointment Status (29 May 2013)

Seán Fleming: 241. To ask the Minister for Health when an appointment for a CT head scan will be given to a person (details supplied) in County Laois; and if he will make a statement on the matter. [26060/13]

Financial Emergency Measures in the Public Interest Bill 2013: Second Stage (28 May 2013)

Seán Fleming: I accept that there is no intention to reduce and that the provision is designed to limit the increase in line with the CPI. It would, therefore, be an adjustment to pensions. The Acting Chairman would probably go a little further than the Minister did in the legislation to which I refer. I see that she has tabled an amendment which is specifically designed to cut pensions in payment for...

Financial Emergency Measures in the Public Interest Bill 2013: Second Stage (28 May 2013)

Seán Fleming: We will have ample opportunity to discuss the matter on Committee Stage. As I have already stated, however, and in the context of the existing legislation, it was not really the Minister's intention to hit public service pensioners whose pensions are in payment. All he was doing was limiting the increase in line with the CPI. However, he has now had a complete change of heart.

Financial Emergency Measures in the Public Interest Bill 2013: Second Stage (28 May 2013)

Seán Fleming: There would be reductions.

Financial Emergency Measures in the Public Interest Bill 2013: Second Stage (28 May 2013)

Seán Fleming: I understand that.

Financial Emergency Measures in the Public Interest Bill 2013: Second Stage (28 May 2013)

Seán Fleming: The position with the Bill before the House is that public service pensions will be hit. A number of amendments relating to this matter have been tabled for Committee Stage. The gist of those in my name is that everyone who is in receipt of an amount of less than €65,000 or €60,000 should be included. Those are the figures in the legislation in respect of the incomes of...

Financial Emergency Measures in the Public Interest Bill 2013: Second Stage (28 May 2013)

Seán Fleming: It may be possible but the Government's approach has been to deal with the issue on a piecemeal basis. As the legislation proceeds, I hope to elicit further information on the savings it is proposed to make under the Haddington Road agreement. Last Thursday, during Oral Questions, the Minister indicated he would provide figures on projected savings. The new agreement adjusts the previous...

Financial Emergency Measures in the Public Interest Bill 2013: Second Stage (28 May 2013)

Seán Fleming: My point is that the Minister met them after the legislation was published. Public service pensioners were not included in any discussion before the Haddington Road agreement and the legislation were published on Thursday last. The meetings took place after publication. Moreover, the list of Committee Stage amendments does not feature any amendments from the Minister. If no changes are to...
