Health (Repayment Scheme) Bill 2006: Report Stage (Resumed) and Final Stage. (31 May 2006)

Seán Ryan: Amendment No. 13 arose from a suggestion put forward by Deputy McManus. We accepted amendment No. 12 but there is a different definition in amendment No. 13. We made the point that it was heavy-handed to have an elaborate appeals system for claims but no right of appeal against demand for repayments where the contractor is satisfied that there has been misrepresentation. In fairness to the...

Health (Repayment Scheme) Bill 2006: Report Stage (Resumed) and Final Stage. (31 May 2006)

Seán Ryan: My apologies. On amendment No. 13, we believe it should have been examined somewhat differently. We are not satisfied with this aspect but given that it is linked to amendment No. 12 I will accept what the Minister is saying.

Health (Repayment Scheme) Bill 2006: Report Stage (Resumed) and Final Stage. (31 May 2006)

Seán Ryan: This is an aspect of the Bill which Deputy McManus felt very strongly about. She felt it could be dealt with in another manner. The amendment, as far as we are concerned, does not deal with the issue and is not a proper definition. It may well lead to problems down the line with regard to misrepresentation. Be that as it may, if the Minister of State is not prepared to come forward with a...

Health (Repayment Scheme) Bill 2006: Report Stage (Resumed) and Final Stage. (31 May 2006)

Seán Ryan: We are discussing the money not being paid. This is linked with an amendment I spoke on previously, and on which nobody seems to want to answer. On the one hand there are fraudulent payments, but I put it to the Minister of State that the State owes money to medical card holders who could not get into public nursing homes. I have asked the question time and again. An elderly person who is...

Health (Repayment Scheme) Bill 2006: Report Stage (Resumed) and Final Stage. (31 May 2006)

Seán Ryan: The Department has failed to answer on it at any stage. People are entitled to health care.

Health (Repayment Scheme) Bill 2006: Report Stage (Resumed) and Final Stage. (31 May 2006)

Seán Ryan: It may not be relevant but the Department will not give an answer on it.

Health (Repayment Scheme) Bill 2006: Report Stage (Resumed) and Final Stage. (31 May 2006)

Seán Ryan: They have an entitlement, but they are not covered in this Bill.

Health (Repayment Scheme) Bill 2006: Report Stage. (31 May 2006)

Seán Ryan: I move amendment No. 2: In page 6, line 2, to delete "including" and substitute "being". This bone of contention for the Labour Party was raised on Second and Committee Stages. Bringing in outside consultants to operate this system cannot be justified. Why is this being proposed? It will lead to additional costs with no guarantee that the system will be better or more efficient. We have some...

Health (Repayment Scheme) Bill 2006: Report Stage. (31 May 2006)

Seán Ryan: That includes the Minister.

Health (Repayment Scheme) Bill 2006: Report Stage. (31 May 2006)

Seán Ryan: Negligent.

Health (Repayment Scheme) Bill 2006: Report Stage. (31 May 2006)

Seán Ryan: As I stated earlier, I did not expect the Minister of State to change his approach at this stage. If the will had been there, it could have been dealt with. It is ideologically driven and it is a vote of no confidence in the departmental staff and the public sector. I am not stating the Department of Health and Children would be the prime mover in this regard, but the Tánaiste and Minister...

Health (Repayment Scheme) Bill 2006: Report Stage (Resumed) and Final Stage. (31 May 2006)

Seán Ryan: Having listened to the Minister of State, I am slightly disappointed that he has not been more proactive in respect of this amendment. I acknowledge that difficulties can arise. If the Minister stated that the policy of his Department was to ensure as far as practicable that all applications would be submitted within 28 days, it might go some way towards demonstrating that the Department is...

Order of Business. (25 May 2006)

Seán Ryan: Given the dangerous condition of Skerries and Balbriggan harbours, will we have to wait until the harbours Bill is introduced before this matter is resolved and we get funding from the Departments to deal with the issue? When will the harbours Bill be published?

Order of Business. (25 May 2006)

Seán Ryan: That means it will not be enacted in the life of this Government. I hope the people of north County Dublin will not have to wait until the harbours fall in before receiving funding. It is an utter disgrace.
