Louise O'Reilly: I believe it needs to be automatic to act as a deterrent. The evidence from the WRC shows that where it inspects places, it uncovers breaches. Providing discretion means the employer is effectively entering into a negotiation with the Department, which I do not think is healthy or appropriate.
