Seanad: An Bille um an Naoú Leasú is Tríocha ar an mBunreacht (An Teaghlach), 2023: An Dara Céim - Thirty-ninth Amendment of the Constitution (The Family) Bill 2023: Second Stage (22 Jan 2024)

Roderic O'Gorman: I beg to differ. It is an important step to give that valid and important constitutional recognition to the tens of thousands of people who are in committed relationships outside of marriage. We have the opportunity to make that change. Our Supreme Court is not going to make the change. We, as legislators, are putting that change to the people on 8 March and we have this opportunity to...

Seanad: An Bille um an Daicheadú Leasú ar an mBunreacht (Cúram), 2023: An Dara Céim - Fortieth Amendment of the Constitution (Care) Bill 2023: Second Stage (22 Jan 2024)

Roderic O'Gorman: I am pleased to present the Fortieth Amendment of the Constitution (Care) Bill 2023 to the House this evening. I thank those who will participate in today’s debate for their continued interest in this significant proposition, which will give the Irish people the opportunity to vote at last on removing the outdated language related to the woman’s role in the home from our...

Seanad: An Bille um an Daicheadú Leasú ar an mBunreacht (Cúram), 2023: An Dara Céim - Fortieth Amendment of the Constitution (Care) Bill 2023: Second Stage (22 Jan 2024)

Roderic O'Gorman: I thank the Acting Chairperson and I also thank Senators for the detailed consideration that they have given the proposals set out in the Bill. The issues we are discussing here are not new. The need, as articulated by many, to amend Article 41.2 to remove the archaic language from that provision, has been discussed in many fora in Ireland through constitutional reviews and citizens'...

In December 2023 the Department launched the Early Learning and Childcare Data...

Written Answers — Department of Children, Equality, Disability, Integration and Youth: International Protection (18 Jan 2024)

Roderic O'Gorman: Payment details for the International Protection Accommodation Service (IPAS) accommodation centres are deemed confidential and commercially sensitive. It would not serve the public interest to divulge payment rates to contractors for services as it could prejudice the Department's negotiating position to deliver value for money with respect to other accommodation providers and locations. ...

Written Answers — Department of Children, Equality, Disability, Integration and Youth: Departmental Data (18 Jan 2024)

Roderic O'Gorman: The Programme for Government contains a commitment to legislate to ban conversion therapy. The National LGBTI Youth Strategy 2018 – 2020 and the National LGBTI+ Inclusion Strategy 2019 – 2021 contain commitments in relation to conversion therapy. The Department of Children, Equality, Disability, Integration and Youth commissioned research into the issue of conversion...

Written Answers — Department of Children, Equality, Disability, Integration and Youth: International Protection (18 Jan 2024)

Roderic O'Gorman: The International Protection Accommodation Service (IPAS) cannot comment on individual cases. Transfers and dispersals of international protection applicants are arranged for a number of reasons, including: maximisation of bed capacity, change in contract or status of centres, medical reasons, and upon request of the applicants. Decisions with respect to applications for international...

Written Answers — Department of Children, Equality, Disability, Integration and Youth: Equality Issues (18 Jan 2024)

Roderic O'Gorman: In the case of the Irish Refugee Protection Programme, beneficiaries are granted refugee status prior to arrival in Ireland. A child with refugee status has the same access to health, education services and other public services as that of an Irish Citizen child. Those seeking asylum in Ireland must make an application for international protection. While that claim is being examined by...

Roderic O'Gorman: The Government has approved Bills for two referendums which will: -amend Article 41 the Constitution to provide for a wider concept of Family; and -delete Article 41.2 of the Constitution to remove text on the role of women in the home, and to insert a new Article 42B to recognise family care. The Referendum Bills have now passed all Stages in Dáil Éireann. Following the passage of...

Written Answers — Department of Children, Equality, Disability, Integration and Youth: Direct Provision System (18 Jan 2024)

Roderic O'Gorman: I thank the Deputy for his question. A response will issue directly to the Deputy in the coming days.

An Bille um an Daicheadú Leasú ar an mBunreacht (Cúram), 2023: Céim an Choiste agus na Céimeanna a bheidh Fágtha - Fortieth Amendment of the Constitution (Care) Bill 2023: Committee and Remaining Stages (17 Jan 2024)

Roderic O'Gorman: In terms of locating the obligation within the family, the approach was adopted because of the particularly onerous and ongoing nature of the care that is provided by so many family carers and the absolute level of support that gives the State. The role of the Meals on Wheels volunteer is, of course, vital in society but I am not sure we can equate that laudable value of a voluntary role...

Roderic O'Gorman: We all know from our work as constituency Deputies that many families are providing this care, that this is a support that the State cannot do without and the depth of their commitment and the depth of the need of their commitment requires that degree of constitutional recognition and also the legal protection that the obligation to strive maintains. To that point, in terms of the use of...

Roderic O'Gorman: My understanding is that we are not able to provide legal advice from the Attorney General. That is my understanding of the position of the Government on this and on all matters.

Roderic O'Gorman: As I will continue to argue, it is far more robust than Article 41.2 which has achieved absolutely nothing for mothers or anybody else in our society. On the use of the words "care" and "carers", this was done very deliberately because there are two or more people in any care-based relationship. Using the word "care" reflects the view of many disability advocates who had expressed...

Roderic O'Gorman: I thank all the Deputies both for their amendments and their detailed contributions to this important debate. As we know, the current proposal in the Bill would delete the existing wording of Article 41.2 in its entirety and insert a brand-new article into the Constitution, Article 42B, which would recognise the role played by the family in terms of support and care provided on an unpaid,...

Roderic O'Gorman: No.

Roderic O'Gorman: I have met them.

Roderic O'Gorman: Tairgim: GO ndéanfar an ráiteas atá leagtha amach sa Sceideal a ghabhann leis an Rún seo a fhorordú mar eolas do vótálaithe, de bhun alt 23 d'Acht an Reifrinn, 1994 (Uimh. 12 de 1994), i ndáil leis an togra chun an Bunreacht a leasú, atá ar áireamh sa Bhille um an Naoú Leasú is Tríocha ar an mBunreacht (An Teaghlach),...

An Bille um an Naoú Leasú is Tríocha ar an mBunreacht (An Teaghlach), 2023: Céim an Choiste agus na Céimeanna a bheidh Fágtha - Thirty-ninth Amendment of the Constitution (The Family) Bill 2023: Committee and Remaining Stages (17 Jan 2024)

Roderic O'Gorman: The very clear Government policy intention in terms of what is protected is relationships that are durable or relationships that are also fundamental unit groups of society and moral institutions like a one-parent family or like a cohabiting couple, whether or not it has children. Those are the relationships we seek to include within this broadened concept of the Constitution.
