- Written Answers — Department of Housing, Planning, and Local Government: Derelict Sites (3 Mar 2022)
Peter Burke: On 31 December 2020, which is the latest date for which data is available in my Department, Wicklow County Council had 4 sites listed on its Derelict Sites register. Data in respect of the end of 2021 is due to be collected in the coming months. While the Derelict Sites Act 1990 does not require local authorities to publish their Derelict Sites Registers on their websites, section 8(5)...
- Written Answers — Department of Housing, Planning, and Local Government: Planning Issues (3 Mar 2022)
Peter Burke: The e-Planning project was commenced with the aims of developing a relatively simple system closely aligned to the already developed Building Control Management (BCMS) system. However, as the detailed analysis for the project progressed, the differences between the standalone nature of the BCMS system and the complexity of e-Planning, including the level of integration required with the...
- Written Answers — Department of Housing, Planning, and Local Government: Planning Issues (3 Mar 2022)
Peter Burke: I propose to take Questions Nos. 269 to 271, inclusive, together. The Town Centre First (TCF) policy, jointly developed by my Department and the Department of Rural and Community Development, sets out 33 actions which will provide a co-ordinated framework across established national policy objectives (in particular the National Planning Framework, Housing for All and Our Rural Future) to...
- Written Answers — Department of Housing, Planning, and Local Government: Planning Issues (3 Mar 2022)
Peter Burke: Planning statistics are compiled by each planning authority on an annual basis for collation and publication on my Department’s website, at the following link: www.gov.ie/en/service/9e4ee-get-planning-statisti cs/. The data collected relates to the total number of applications and decisions for all developments that require planning permission, broken down by year and planning...
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: I will address amendments Nos. 2 and 13. I must oppose amendment No. 2, which would provide that the Minister shall provide a report examining the establishment of a statutory skills register. The Bill provides for a register of providers of building works. The competence criteria for registration in each division of the register are determined by the board and approved by the Minister and...
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: Yes.
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: We will first look at builders and then go through the various trades stage by stage. That is what is intended.
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: Yes. For clarity, we are saying builders of buildings will be first and trades will follow. I am advised that by mid-2024, the register of builders will be complete, with trades to follow.
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: I am advised that the Department is working with the Department of Further and Higher Education, Research, Innovation and Science surrounding what Deputy Ó Broin mentioned. It is very keen to point out that this is on competence. We just want to be careful in terms of the parameters when we are talking about a register. Work is going on across Government in line with the...
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: That is okay. I can do that.
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: Absolutely. That is the intention.
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: I thank the Deputies for their amendments. I will address amendments Nos. 3 and 4. Section 8 of the Bill provides that the Government may make an order appointing a body to perform the functions of the registration body. It sets out that the body can be a public body or otherwise and it provides that the body must be capable of performing the functions conferred. I must oppose amendment...
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: Deputy Ó Broin referred to the voluntary register. In the main, it would obviously be compliant members who registered on the voluntary register. It is unfair to make some of the suggestions that have been made. The reason infringements are lower and cases are not taken against members is that it is a voluntary register. The Royal Institute of Architects of Ireland and the Society...
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: In the first instance, as I pointed out, CIF has the experience from operating the voluntary register. Second, it is unfair to cast aspersions on the voluntary register in terms of infringements because of its voluntary nature and the fact that people are mostly compliant. Third, as I also pointed out, it has the skill sets and reference. Fourth, and critically, it is underpinned by an...
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: I thought the Deputy was just going to withdraw the amendment on foot of the error, and that there was not going to be any question on it at all. I am told that in other pieces of legislation this is a standard clause, in line with the Charities Act 2009 for example. That is my advice here.
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: We are told that it is a standard clause. I will have a look and come back to the Deputy. I have the briefing here on the public policy part but I would have to have a look at the morality piece. I do not have the exact answer myself.
- Select Committee on Housing, Planning and Local Government: Regulation of Providers of Building Works Bill 2022: Committee Stage (3 Mar 2022)
Peter Burke: I will yes.
