Mark Ward: I agree. Mr. Farrelly should never apologise for using simplistic language. Much of the comment last night was about some of the language within the legislation.

- Joint Committee On Children, Equality, Disability, Integration And Youth: General Scheme of the Assisted Decision-Making (Capacity) (Amendment) Bill 2021: Discussion (Resumed) (16 Feb 2022)
Mark Ward: I am not sure if I got an answer to one of the questions I asked Ms Flynn of the DSS earlier relating to the consultation process and disabled persons' organisations feeling left out of the process. I believe she mentioned that it was not under her remit. If not, who was responsible for that? Was it the Department? If it was the Department, can Ms Baxter answer the question? Does she...

Mark Ward: My final question is directed to Mr. Farrelly. He mentioned that he feels the Mental Health Commission is a more compatible home for the DSS than the courts system. Were any concerns raised with him about keeping the service within the courts system? If so, who raised it and what was the outcome of that?

- Joint Committee On Children, Equality, Disability, Integration And Youth: General Scheme of the Assisted Decision-Making (Capacity) (Amendment) Bill 2021: Discussion (Resumed) (15 Feb 2022)
Mark Ward: I am pleased to contribute on this important legislation. I am aware this meeting is being signed and I would like to use some sign language. My niece, Caitlin, who uses sign language sat me down last night and showed me how to do a little sign language. I want to use the following sign language to welcome the representatives of the deaf community to this meeting. That is important. As...
- Joint Committee On Children, Equality, Disability, Integration And Youth: General Scheme of the Assisted Decision-Making (Capacity) (Amendment) Bill 2021: Discussion (Resumed) (15 Feb 2022)
Mark Ward: I appreciate Mr. McGrath's answer. My second question is for Ms Coyle or Ms Grogan. Part 8 of the legislation and the lacuna between the Mental Health Act and this Bill was mentioned. I am a member of the two committees dealing with those two items of legislation. As a layperson, it is difficult to get my head around what is involved. We heard that it was hoped a remedy would be found to...

Mark Ward: I thank Ms Grogan for that. In layman's terms, if the Bill is not amended and the Mental Health Act is amended to include 16- and 17-year-olds in decision making, what is the danger? What could happen with the two different Acts?

Mark Ward: Dr. Harnett and others indicated that the draft codes of practice should be reviewed in a year. What should the review look like and who should conduct it? Would it be independent or would it be carried out by the HSE or Tusla? Whoever it might be, I wonder what Dr. Harnett's thoughts are on the matter.
- Joint Committee On Children, Equality, Disability, Integration And Youth: General Scheme of the Assisted Decision-Making (Capacity) (Amendment) Bill 2021: Discussion (Resumed) (15 Feb 2022)
Mark Ward: I am on the same page as our guests when it comes to the arbitrary deadline. I have stated previously that this is a rushed process. While this is important legislation, it needs to be done properly. Mr. Dunne mentioned some of the unintended consequences, for example, regarding guard rails, which were not on my radar. I thank all the witnesses for sharing today.
