Terry Leyden: I understand that, but I understand it is only in the event of a question mark over the qualification. I do not believe the High Court judge would be required if questions did not arise. It is a matter for the Clerk of the Seanad to decide on the qualifications of the person, subject to appeal to a High Court judge.
