Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Completion of the Examination of the Report and Recommendations of the Citizens' Assembly and Preparation of a Draft Report in accordance with the Terms of Reference of the Joint Committee (13 Dec 2017)

Jonathan O'Brien: Chairman, it is my understanding that we are putting the question on reason 6.

Jonathan O'Brien: I said at the outset that we should vote on every single recommendation. I do not have an issue with that. However, if we are now trying to link reason 13 to a gestational period which is in the Citizens' Assembly recommendation then I do object to that. We have not done that with any of the other recommendations. We have voted just on the reason. We have not taken a decision. If that...

Jonathan O'Brien: Where it states, "procure an abortion for herself", I propose it should say, "regardless of the circumstances".

Jonathan O'Brien: I propose the insertion of "regardless of the circumstances". If we are saying that terminations can be carried out in a hospital or licensed clinic, or through the licensing of medications, that is the correct way to do it, but if a woman accesses a termination outside of those two grounds, she should not face any criminal sanction. That is my difficulty.

Jonathan O'Brien: If a member wants to make some points, let him or her make a few. I do not mean that in a disrespectful way, but if there are some points to be made, they should be made and we can then move on.

Jonathan O'Brien: The Senator said he has never interrupted. I had indicated Chairman. I have no objection to taking all of the ancillary recommendations together. I do have concern around motion 47 and clarification if can be given. It says that "the committee recommend that improvement should be made to counselling and support facilities for pregnant woman". I have no issue with that. It goes on to say...

Jonathan O'Brien: I think it should read that the committee recommends that improvements should be made to counselling and support facilities for pregnant women, appropriate counselling should be provided to women as necessary during pregnancy, and, if necessary, following pregnancy.

Committee on Budgetary Oversight: Revaluation of Local Property Tax and Commercial Stamp Duty: Revenue Commissioners (12 Dec 2017)

Jonathan O'Brien: Most of the questions I had have already been asked but I have a brief one related to the revaluation process. Mr. Walsh commented that Revenue would probably start preparing that process at the end of next year. Could he give members some detail of the timescale which would be needed by the Revenue Commissioners to carry out that revaluation process?

Committee on Budgetary Oversight: Revaluation of Local Property Tax and Commercial Stamp Duty: Revenue Commissioners (12 Dec 2017)

Jonathan O'Brien: Following on from Deputy Boyd Barrett's point on a significant increase arising for many people as a result of that process, does Mr. Walsh believe that would have an impact on compliance rates? Were a home owner to have a large increase in his or her local property tax demand within the space of three months, would that form part of Revenue's forecasts in terms of how such increases could...

Jonathan O'Brien: How likely is that?

Jonathan O'Brien: Revenue would have a mandatory deduction at source as part of that.

Committee on Budgetary Oversight: Revaluation of Local Property Tax and Commercial Stamp Duty: Revenue Commissioners (12 Dec 2017)

Jonathan O'Brien: I wish to raise a number of issues, on some of which Mr. Walsh touched in his replies to Deputy Martin Heydon. The first relates to the commentary since the budget on how accurate and reliable is the figure presented in the budget. Mr. Walsh has outlined the process Revenue went through to arrive at the figure, taking out one-off large-scale sales. I would appreciate a little more detail...

Committee on Budgetary Oversight: Revaluation of Local Property Tax and Commercial Stamp Duty: Revenue Commissioners (12 Dec 2017)

Jonathan O'Brien: Mr. Walsh may not be aware of this, but I have just been handed a note. Facebook has announced that it is moving to a local selling structure in countries where it has offices. It means that the company's advertising revenue will no longer go through its headquarters in Dublin. Can Mr. Walsh comment on this? I will not put him on the spot by asking him how it will affect corporation tax...
