Pre-European Council: Statements (21 Jun 2017)

Mick Wallace: 3 o’clock I am sharing time with Deputy Broughan. I regret that the new Taoiseach is following in the footsteps of the old Taoiseach by departing the scene before the smaller parties or Independents have their say.

Pre-European Council: Statements (21 Jun 2017)

Mick Wallace: I am sorry. What would he like to be called?

Pre-European Council: Statements (21 Jun 2017)

Mick Wallace: Former. I take back "old". It was not an ageist thing, trust me. I am nearly as old as him myself. Perhaps the new Taoiseach feels the esteemed leaders of the established parties talk more wisdom than us poor mortals. So be it. I understand that the European Council meeting is mostly about migration and defence, or refugees and war, whichever way one looks at it. It would be good if...

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: I thank the Mr. Kelleher for his presentation. This matter seems to be growing more complicated by the day.

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: I think I know less about it now than I thought I knew at the start. On the last point, the argument seems to be on whether Big Brother is an element of the State or of the private sector. It is a difficult choice.

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: I suspect that the Irish State will not want to do this and will probably be happy to leave it to the private sector.

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: I would probably be more comfortable with the State doing this. For all the concern I might have about this, I would have more concerns about the private sector because it obviously has an ulterior motive. The private sector makes money and it makes its decisions and does what it does in order to maximise earnings. That would be the driving force for the private sector if it were to get...

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: At a guess, what kind of costs? Does the witness have any idea what the cost would be to the State if it were to take on this responsibility?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: Mr. Kelleher started off talking about how important it is that the Data Protection Commissioner is truly independent.

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: If the Government decides on a yearly basis how much funding she will have access to, does that not limit her independence?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: Would there be any merit in Europe deciding just how much she should get on an annual basis?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: For my last question, Mr. Kelleher was talking about how one would deal with those in public bodies which infringe people's data protection rights. He states that if it would be fines, it would be merely a circular movement and the money would just go around.

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: Is it a problem if there is no real deterrent for officials to be careful in how they are doing it?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: What does that amount to?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: Is Mr. Kelleher saying charges of illegality would be brought against the individual responsible rather than the body?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: Mr. Kelleher states it is likely that the people would be able to bring a class action. Given that it is not possible in Ireland at present, how will that happen?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Data Protection Bill 2017: Discussion (Resumed) (21 Jun 2017)

Mick Wallace: I thank Mr. Kelleher.

Written Answers — Department of Health: General Practitioner Services Provision (21 Jun 2017)

Mick Wallace: 115. To ask the Minister for Health further to parliamentary Question No. 79 of 8 March 2017, the measures he is planning in order to ensure that general practitioners do not incorrectly charge medical card holders for routine phlebotomy services; his plans to introduce sanctions for general practitioners that continue to charge patients incorrectly in this regard; and if he will make a...

Offences Against the State (Amendment) Act 1998 and Criminal Justice (Amendment) Act 2009: Motions (20 Jun 2017)

Mick Wallace: I congratulate the Minister on his new job. Perhaps we will get on better than we expect. Once again we are having an inconsequential debate on Ireland's flouting of international human rights law. Each year, the same points are put forward and each year the Government ignores the arguments and extends these pieces of legislation which have been repeatedly criticised by a range of human...

Written Answers — Department of Arts, Heritage and the Gaeltacht: Arts Promotion (20 Jun 2017)

Mick Wallace: 100. To ask the Minister for Arts, Heritage and the Gaeltacht if her Department has carried out research into Iceland's policies on arts and culture and in particular a policy (details supplied); if she will consider establishing a similar resource for the Irish music industry; and if she will make a statement on the matter.
