Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: To clarify something in regard to the cross-Border body and the agreement on which it was set up, we cannot extend the remit of Waterways Ireland. We can legislate within the remit for the South, which is for the Grand Canal, the Royal Canal, the Barrow and the Shannon, but not the Erne part of it. We can do that within the remit of what we have but we cannot extend the remit of Waterways...

Heather Humphreys: This is on-----

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: That is okay, but not the safety. It is the safety that I am talking about.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: I will come back to that because I am not quite sure what the Senator is referring to. I was talking about amendment No. 1h.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: Following, "the regulation of the conditions (including conditions as to safety) under which boats may be used on the canals;", the Senator wants to insert, "subject to agreed criteria for safety standards aboard a vessel and adjudicated upon by a suitably qualified person", but what I am saying is that safety standards are a matter for the Department of Transport, Tourism and Sport.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: The type of boat is regulated but not safety on the boat. Health and safety issues on the boat are a matter for the Department of Transport.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: I will come back to the Senator on it. We are regulating the use of the canals not the use of the boats. In regard to Senator Craughwell's amendments Nos. 1j and a1k, these proposals overly limit the closing of navigation to emergency situations and does not take account of other reasons why a navigation can be closed, such as land drainage, flood management and control, when a loss of...

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: Yes but the issue is what are "agreed procedures?" We could end up tying ourselves up in knots as to what is an emergency situation. An emergency is an emergency. We do not want to legislate such that if a person is drowning it would be necessary to consider agreed procedures. I accept that is an extreme example.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: We can consider that in the context of the by-laws. I think I have covered all of the points raised.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: I have already addressed that issue.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: It will go out for public consultation. I have a response to Senator Alice-Mary Higgins's earlier question. We can regulate use of boats, for example boats passing each other or the speed of boats, but we cannot regulate for safety on board boats.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: I wish to inform the House at this point that I intend to bring an amendment on Report Stage to the proposed section (7)(1)(j) to update the title of the Minister for Communications, Energy and Natural Resources to the current title of Minister for Communications, Climate Action and Environment, as well as to subsection (7)(1)(p). I also intend to bring forward amendments to sections...

Written Answers — Department of Arts, Heritage and the Gaeltacht: Cultural Policy (2 Mar 2017)

Heather Humphreys: The Taoiseach and I launched the Creative Ireland Programme/Clár Éire Ildánach 2017 – 2022 on the 8 December 2016 as the Government Legacy Programme for Ireland 2016 and as the main implementation vehicle for the priorities identified in Culture 2025/ Éire Ildánach, the draft cultural policy which I published in July 2016. In Budget 2017, I secured €5m...

Written Answers — Department of Arts, Heritage and the Gaeltacht: Arts Funding (2 Mar 2017)

Heather Humphreys: The Arts and Culture Capital Scheme was considerably over-subscribed. The Department received 106 applications in total under Stream 1 and 2 seeking total funding of over €20m with eligible requests for funding totalling over €14.6m. A total of 56 projects were selected for funding of €9m based on the detailed selection criteria and eligibility requirements which...

Written Answers — Department of Arts, Heritage and the Gaeltacht: Rural Development Plan (2 Mar 2017)

Heather Humphreys: The Action Plan for Rural Development was launched on 23 January this year and includes many schemes and programmes for implementation across a range of Government Departments, State agencies and other organisations over the next three years. I assume the Deputy's question refers to the Town and Village Renewal Scheme which comes under my Department's remit. I have secured funding of...

Written Answers — Department of Arts, Heritage and the Gaeltacht: Legislative Process RIA (2 Mar 2017)

Heather Humphreys: I propose to take Questions Nos. 172 and 173 together. As I informed the House in my response to Parliamentary Question No. 284 of 23 February, my Department carried out Regulatory Impact Assessments in respect of the Amendment of the National Archives Act 1986 (October 2014) and the Implementation of De-designation Proposals of the Review of Raised Bog Natural Heritage Area Network under the...

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Archives (Amendment) Bill 2017: Discussion (1 Mar 2017)

Heather Humphreys: I thank the committee for the invitation to address it today on the National Archives (Amendment) Bill. I just want to say that we have been here since 2.15 p.m. and it is planned that we will leave around 4.30 p.m. That was the anticipated time as I believe other officials will come in at that stage. This proposed legislation will provide the flexibility for certain Departments to...

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Archives (Amendment) Bill 2017: Discussion (1 Mar 2017)

Heather Humphreys: The Senator has rightly pointed out that an addition is being made to the Bill. I decided to make this change, after giving careful consideration to the move to a 20-year rule, because I am of the opinion that notwithstanding the significant resourcing issues involved, it is important to provide for the early release of records of significant historical or public interest value. We are...

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Archives (Amendment) Bill 2017: Discussion (1 Mar 2017)

Heather Humphreys: I would never assume that.

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Archives (Amendment) Bill 2017: Discussion (1 Mar 2017)

Heather Humphreys: That is right.
