Seán Fleming: We can also acknowledge that the HSE, whose letter I am quoting, says that it does not anticipate that any challenge will be brought. Not only is it not sub judice, the HSE is saying it does not expect it to be. That is the HSE's call, not ours. I am just recording it.

Seán Fleming: The Deputy's point is quite right. I had to move myself to have a meeting before the Dáil recess. I understood the Dáil was sitting next Friday and thought it was a safe date on that basis. It was the only day they were available. We had to get clearing from the business committee to hold this unscheduled meeting. I had to act a bit unilaterally.
