Select Committee on Justice and Equality: Civil Liability (Amendment) Bill 2017: Committee Stage (29 Jun 2017)

Mick Wallace: There are some powerful people working in the HSE and An Garda Síochána.

Select Committee on Justice and Equality: Civil Liability (Amendment) Bill 2017: Committee Stage (29 Jun 2017)

Mick Wallace: It is not the foot soldiers who are the problem; unfortunately, it is the hierarchy. I again refer the Minister of State to the Patten report. We could improve both these organisations so much, and the Minister of State's philosophy and ideas would work and flourish in the organisations if we could get rid of the hierarchies in both.

Select Committee on Justice and Equality: Civil Liability (Amendment) Bill 2017: Committee Stage (29 Jun 2017)

Mick Wallace: We are afraid of the Chairman.

Select Committee on Justice and Equality: Civil Liability (Amendment) Bill 2017: Committee Stage (29 Jun 2017)

Mick Wallace: Very right.

Written Answers — Department of Finance: NAMA Loans Sale (29 Jun 2017)

Mick Wallace: 107. To ask the Minister for Finance further to Parliamentary Questions Nos. 15 and 31 of 18 May 2017, the reason Project Shift was not discussed at Northern Ireland advisory committee meetings; if a person (details supplied) advised the debtor regarding the project; and if he will make a statement on the matter. [30742/17]

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: When Deputy O'Callaghan asked the Minister about the former Attorney General remaining in the Cabinet room as her candidacy was discussed and whether it was a breach of fair procedure, the Minister said it was perfectly lawful and he was fine with it. It may have been within the law but can he argue that it was fair procedure?

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: I am not asking the Minister to contravene Cabinet confidentiality. While we are in agreement it was within the law for the former Attorney General to be in the room, does he think that is a fair way to carry out business of this nature?

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: The Minister stated: "... the JAAB reported on 16 May 2017 that it was not in a position to recommend a person for appointment to the vacancy in the Court of Appeal." The former Attorney General was a member of the board. Did the board give an explanation as to why they were not in a position to recommend anybody?

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: The Minister said: "The Government acted entirely within its constitutional powers and responsibilities in making this nomination". I fully agree the Government acted within its constitutional power regarding what it did but in the context of responsibilities, does it not have a responsibility to the people of Ireland? Does he think the Government acted in a responsible manner on behalf of...

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: Does the Minister accept that he has responsibilities to the public?

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: Does the Minister think the public is happy with the manner in which this was dealt with?

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: All this happened before we began to debate the reform of judicial appointments. Given the proposed legislation is expected to go some way towards addressing the issue of political interference in how judges are appointed, does the Minister think it is a little ironic that the Government parties in the manner of this appointment before we debated the depoliticisation of judicial appointments...

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: The Minister also stated that in the appointment of Ms Justice Máire Whelan to the Court of Appeal, the Government appointed a suitable person who was appropriately qualified using a correct process. Given the Minister is prepared to make comment on her suitability and her qualifications, it is fair to ask the following question: is it of concern that the Fennelly commission saw fit to...

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: I understand that and I respect that. I will not comment on what kind of job she will do as judge. I will not stray into that, but the Minister raised the issue of her suitability before she became a judge as to whether she was appropriately qualified. We read the Fennelly report and her role in that is shocking. I do not even want to go into the Siteserv or the children's referendum...

Joint Oireachtas Committee on Justice, Defence and Equality: Court of Appeal Appointment: Discussion (28 Jun 2017)

Mick Wallace: This is my last question. It is pretty much accepted that public trust and confidence in politics in Ireland has been eroded over a number of years. Would the Minister agree that the manner in which the Government has handled the appointment of Máire Whelan to the Court of Appeal has further eroded public trust and confidence in the way we do politics?

European Council: Statements (28 Jun 2017)

Mick Wallace: I congratulate the Minister of State on her new appointment. I again express my disappointment that the Taoiseach does not feel we are worth listening to. Perhaps we need to give him more reason to show some respect. The EU tends to view the refugee crisis as a defence and security issue. However, this is deeply destructive and separate from the real problem. As others have said, we...

Select Committee on Justice and Equality: Mediation Bill 2017: Committee Stage (28 Jun 2017)

Mick Wallace: My amendment is much the same as Deputy Daly's and the Minister has more or less addressed it. I think we are all on the same wavelength. We do not have an issue with it.

Select Committee on Justice and Equality: Mediation Bill 2017: Committee Stage (28 Jun 2017)

Mick Wallace: I move amendment No. 2:In page 6, line 21, after “means a” to insert “confidential”. Confidentiality is a very important aspect of mediation and one of the main reasons for the success of the process. We note the Mediators' Institute of Ireland was concerned that if the confidential nature of mediation was to be in any way undermined, parties to a dispute would...

Select Committee on Justice and Equality: Mediation Bill 2017: Committee Stage (28 Jun 2017)

Mick Wallace: I move amendment No. 10:In page 9, line 17, after “and (8)” to insert “and subject to the confidentiality of the mediation”. I will pick up again on how the Law Society recommends that a mediator statement of general reasons for withdrawing must be subject also to confidentiality of mediation.

Select Committee on Justice and Equality: Mediation Bill 2017: Committee Stage (28 Jun 2017)

Mick Wallace: I would have thought that it made sense. I know it is not the end of the world, but I still think I should probably press it. I do not think it is unreasonable of me to press it, so I will.
