National Training Fund (4 Jul 2013) Kieran O'Donnell: Roughly, one is talking about 13%, or just over one in ten courses. Does Dr. Fields think that is adequate?

National Training Fund (4 Jul 2013) Kieran O'Donnell: Is there a tracking system in that having done a course, FÁS knows whether somebody is in employment? Mr. O'Toole spoke about a survey. When somebody does a course, has FÁS some way of knowing what he or she is doing over the following 12 months? Is there a database to see if courses are fulfilling the criteria for the market and to ensure people get jobs?

National Training Fund (4 Jul 2013) Kieran O'Donnell: I refer to the European Globalisation Adjustment Fund. Obviously, coming from Limerick and given what happened with Dell, I have a particular interest in it. In regard to the funding which has been returned to the EU, in Dell's case, 40% was returned. Interestingly, in the case of Waterford Crystal, it was a low as 20% while in the case of SR Technics, it was 60%. In terms of NACE 41,...

National Training Fund (4 Jul 2013) Kieran O'Donnell: I apologise for being late. I wish to touch on a couple of issues. I do not know if my general question has been asked already. The total annual budget stated in the FÁS annual report for 2011 was just short of €1 billion, but programmes cost €736 million, overheads cost €40 million, pension cost €62 million and staff cost about €105 million. If one...

National Training Fund (4 Jul 2013) Kieran O'Donnell: Let us reduce that figure to about €2,300 per job.
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: Taking up Deputy McNamara's point, could it be taken that section 22(4) could prove to be inconsistent with section 22(1), which states it shall be an offence to intentionally destroy unborn human life? For the avoidance of doubt or any conflicts or inconsistencies, should section 22(4) be deleted? Does it cause more confusion than clarity when the primary section is section 22(1)?
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: Is it case law?

Kieran O'Donnell: What is the legal basis of the sentence of 14 years?
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: I welcome amendment No. 83 and thank the Minister for moving it.
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: If a medical procedure was carried out by a hospital following a review, the hospital would be required automatically under the Act to send a notification to the Minister, similar to the notification we are inserting in section 18. There will be no need to reiterate in amendment No. 83 that this will be in sections 7, 8, 9 and 13.
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: I would like the Minister to clarify something. I cannot see where it is set out in the Bill that notifications for the registration of medical practitioners who will carry out procedures under the reviews will be provided to the Minister. Can the Minister tell me where that is provided for in the Bill?
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: I want to speak on amendments Nos. 69 and 73. I welcome the Minister's amendments. Amendment No. 73 refers to confidentiality, which is important. With the indulgence of the Chairman, I want to make reference to amendment No. 83, which is relevant. Deputy Ciara Conway referred to the registration numbers of medical practitioners. There appears to be an inconsistency in this regard....
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: I wish to raise a point in the interest of consistency. Section 13(6) states: "In subsection (3) “jointly certify”, in relation to the review committee, means that all of the members of the committee make the section 13 certification concerned." That provides clarity on "jointly certify", but that paragraph does not appear in sections 7, 8 and 9. For the sake of consistency...
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: I see that in sections 7(1)(b) and 9(1)(b) but section 13(6) refers to jointly certify in respect of section 13 overall.
- Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)
Kieran O'Donnell: I am not seeking that. I am just raising the technical point. Section 13(3) provides that the committee shall, subject to section 19, jointly certify, and subsection (6) states what jointly certify means. If that paragraph was also included in sections 7, 8 and 9 it would give absolute clarity about what "jointly certify" means in those sections as well.
