David Norris: Section 37 explicitly states: "Nothing in this chapter or chapter 2 shall be construed as being applicable to a judicial office to which section 44 applies." Section 44 is bang in the middle of it. It is directly germane, as is Senator McDowell's amendment and he has already spoken about his amendment because it is directly relevant.

I want to say that this amendment codifies a procedure that this Government has adopted in recent senior court appointments and it follows that this process should continue on a statutory basis.
