Joint Oireachtas Committee on Climate Action: Biodiversity: Engagement with Department of Housing, Local Government and Heritage (14 Jun 2022)

Jennifer Whitmore: I have just joined the meeting and I hope I will not ask questions Dr. Lynn has already answered. My first question is on the European Green Deal and the ambitious target of protecting 30% of land and sea by 2030. We have signed up to this on a global and European level but my understanding is that we have not signed up to it at national level. Does that need to happen? Will it be...

Jennifer Whitmore: There is a covenant or grouping we signed up to that was more global.

Joint Oireachtas Committee on Climate Action: Biodiversity: Engagement with Department of Housing, Local Government and Heritage (14 Jun 2022)

Jennifer Whitmore: Dr. Lynn made the point earlier on that biodiversity needs to be addressed holistically and it is very much a cross-portfolio issue. The siloing of biodiversity within one Department or another can cause difficulties. Dr. Lynn spoke about the financial issues and considerations. There are biodiversity elements to areas such as planning and flood defences. Are the structures in place to...

Select Committee on Children and Youth Affairs: Assisted Decision-Making (Capacity) (Amendment) Bill 2022: Committee Stage (14 Jun 2022)

Jennifer Whitmore: My party colleague, Deputy Cairns, is unable to make it today. This amendment addresses concerns about respecting advance healthcare directives for individuals engaging with mental health. Under section 85(7) of the 2015 Act, an advance healthcare directive will not be complied with as it relates to the refusal of mental health treatment is the directive maker is detained under the Mental...

Select Committee on Children and Youth Affairs: Assisted Decision-Making (Capacity) (Amendment) Bill 2022: Committee Stage (14 Jun 2022)

Select Committee on Children and Youth Affairs: Assisted Decision-Making (Capacity) (Amendment) Bill 2022: Committee Stage (14 Jun 2022)

Jennifer Whitmore: This amendment deletes the Minister's proposal to remove treatment decisions from enduring power of attorneys, EPAs. Separating decisions about healthcare treatment and enduring powers of attorney will create additional complications for individuals. In essence, if someone wants to plan his or her healthcare decisions in advance, he or she would have to create not one but two instruments,...

Select Committee on Children and Youth Affairs: Assisted Decision-Making (Capacity) (Amendment) Bill 2022: Committee Stage (14 Jun 2022)

Jennifer Whitmore: Amendment No. 35 addresses both the problematic language and the intention in the Bill. While updating of the Juries Act 1976 is welcome, the current wording needs to be improved. It needs to be amended. We presume when the Bill refers to mental or intellectual incapacity rather than capacity that that is a typo, as Deputy Sherlock mentioned. However, even the language "mental or...

Select Committee on Children and Youth Affairs: Assisted Decision-Making (Capacity) (Amendment) Bill 2022: Committee Stage (14 Jun 2022)

Jennifer Whitmore: I move amendment No. 35: In page 62, to delete lines 28 and 29 and substitute the following: “ “A person who, arising from his or her ill health, is resident in a hospital or other similar health care facility or is otherwise (with permissible and practicable decision-making supports and reasonable accommodation consistent with the right to a trial in due course of law)...

Select Committee on Children and Youth Affairs: Assisted Decision-Making (Capacity) (Amendment) Bill 2022: Committee Stage (14 Jun 2022)

Jennifer Whitmore: Our amendment relates to the same measure. It comes back to the issue of "nothing about us without us". It is important to have people who have lived experiences actually inputting into these policy discussions. This is a simple and small measure and it could have a huge impact. I would ask that the Minister consider the amendment.
