Seanad: Health (Miscellaneous Provisions) Bill 2009: Second Stage (2 Jul 2009)

Brendan Ryan: I have been pursuing the case of an 89 year old Balbriggan woman who is ready for release from Beaumont Hospital. Her family has identified an available public bed in Gormanstown, a couple of miles away. She cannot be released because no funding is available from the HSE. Unfortunately, she is not alone as 130 older people are in a similar situation in Beaumont Hospital holding up beds in...

Seanad: Criminal Justice (Surveillance) Bill 2009: Committee and Remaining Stages (2 Jul 2009)

Brendan Ryan: I thank the Minister and his staff for their attention to detail and their response to the various issues raised. There were a number of contentious issues which were well aired and debated. On the basis that the Minister has agreed to deal with those issues in the Dáil, I was prepared to vote for the Bill on behalf of the Labour Party.

Seanad: Aviation (Preclearance) Bill 2009 [Seanad Bill amended by the Dáil]: Report and Final Stages (1 Jul 2009)

Brendan Ryan: I thank the Minister for the manner in which he has treated the House during the passage of this legislation through the Oireachtas. It is a welcome development that such a number of Bills, including this one, have commenced in this House. It is only fair to give credit to the Leader for his efforts in this regard. The Minister accepted a number of amendments put forward by the Labour Party...

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: I do not agree with the Minister the amendment opens up the possibility that other forms of arms would be allowed, but I hear his assurances. If he feels he can return with a wording that maintains the spirit of our amendment in not allowing firearms, and can improve on it, I will accept his assurance in that regard. I will not press the amendment.

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: May I comment on that?

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: According to a letter I received, the proposed amendment is similar to one that was negatived on Committee Stage. Although there is some similarity, this amendment deals with the response of the Minister on the day.

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: You are Acting Chairman.

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: I accept the ruling but under severe protest.

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: I move amendment No: 3: In page 9, line 5, to delete "or is otherwise expedient" and substitute the following: "or the person being searched is a minor or a person with an intellectual disability and the person of the other sex who is present is a parent, guardian or relative of that person or is a person whose presence is otherwise in the best interests of the person being searched". We...

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: The Minister will recall that our difficulty with the wording in this section concerned the use of the phrase, "or is otherwise expedient". Our original amendment proposed to remove only that wording. We felt the preceding wording was sufficiently strong to deal with the issues. The Minister's response was to raise the matter of minors. We were happy to come up with a form of wording...

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: I have nothing to add. The amendment was merely to correct a drafting error and I am happy the Government has accepted and moved it.

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: I thank the Minister for the spirit in which he engaged in debate on the Bill and on the amendments tabled by Senators. I welcomed the Bill on Second Stage and congratulated the Minister on his part in bringing the agreement forward. It is something that will benefit the people and has the potential to benefit business. I thank the Minister for his positive response.

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: I move: "That the Bill be recommitted in respect of amendment No. 1."

Seanad: Aviation (Preclearance) Bill 2009: Report and Final Stages (16 Jun 2009)

Brendan Ryan: I move amendment No. 1: In page 7, between lines 26 and 27, to insert the following: "(2) A preclearance officer may not be in possession of a firearm in the course of exercising any function under this Act.". The purpose of the amendment is to make it clear that the officials from the United States of America must be unarmed. On Committee Stage I welcomed the statement from the Minister...

Seanad: Aviation (Preclearance) Bill 2009: Committee Stage (11 Jun 2009)

Brendan Ryan: I move amendment No. 3: In page 7, subsection (2), between lines 21 and 22, to insert the following: "(b) not require the person to remove any garment other than an outer garment save in the presence of and subject to the directions of an Irish law enforcement officer,". This amendment is in the section describing the functions of preclearance officers, who are officials from the US side. We...

Seanad: Aviation (Preclearance) Bill 2009: Committee Stage (11 Jun 2009)

Brendan Ryan: I do not accept the Minister's view on that. We are just asking that there be a specific requirement stating, "other than an outer garment save in the presence of and subject to the directions of an Irish law enforcement officer". I do not see the downside of including this. I do not understand the Minister's view that this provision, rather than amendment No. 4, would give the US side...

Seanad: Aviation (Preclearance) Bill 2009: Committee Stage (11 Jun 2009)

Brendan Ryan: The reference to "expedient" in the phrase "or is otherwise expedient" renders the protection meaningless. Does it not undermine the right to be searched in the presence of the other sex?

Seanad: Aviation (Preclearance) Bill 2009: Committee Stage (11 Jun 2009)

Brendan Ryan: I move amendment No. 8: In page 13, subsection (4), line 31, to delete "Where" and substitute the following: "Without prejudice to any other power of a Minister of the Government, where". We propose the inclusion of the above wording. The power to order the removal of a preclearance officer exists only where the officer has abused his position, as outlined in the section. Clearly, this...

Seanad: Aviation (Preclearance) Bill 2009: Committee Stage (11 Jun 2009)

Brendan Ryan: I move amendment No. 9: In page 14, subsection (2), line 34, after "officer" to insert "(other than a member of the Garda Síochána)". An assault on a member of the Garda Síochána is already punishable by seven years' imprisonment under section 19 of the Criminal Justice (Public Order) Act 1994, as amended by section 185 of the Criminal Justice Act 2006. The Bill would introduce a lower...

Seanad: Order of Business (11 Jun 2009)

Brendan Ryan: Immediately after the Order of Business we are to take Committee and Remaining Stages of the Aviation (Preclearance) Bill. Unfortunately, no time has been provided between Committee and Report Stages for this Bill. Many Senators know this is a very important space between Committee and Report Stages, which provides the opportunity for the Minister and officials to reflect on some of the...
