Seanad: Planning and Development (Amendment) Bill 2009: Committee Stage (Resumed) (25 Nov 2009)

Brendan Ryan: This section is a blow to democracy. Currently, the occupiers of a development have a right to vote on whether it is taken in charge. The Bill will remove this right and confer it on the owners rather than the occupiers. The Minister of State claims that he is following the Law Reform Commission's recommendations, but we suggest that this provision be deleted.

Seanad: Planning and Development (Amendment) Bill 2009: Committee Stage (Resumed) (25 Nov 2009)

Brendan Ryan: I acknowledge the Minister of State's response, but the legislation will bestow the right on owners only. Since the occupiers should also have a role, we oppose this section. However, I do not propose to press the issue.

Seanad: Planning and Development (Amendment) Bill 2009: Committee Stage (Resumed) (25 Nov 2009)

Brendan Ryan: I do not wish to go over ground that has been covered, but unfinished estates constitute a major problem. I live and operate in Fingal, where this has been a significant problem for years. Notwithstanding the Minister of State's assertion that the local authority has powers to deal with it, the council is obviously not using those powers. Should we be happy that authorities are not using...

Seanad: Foreshore and Dumping at Sea (Amendment) Bill 2009: Committee and Remaining Stages (25 Nov 2009)

Brendan Ryan: I move amendment No. 3: In page 12, between lines 5 and 6, to insert the following: "(4) The making of submissions by a local authority under regulations under this section or under section 19A shall be a reserved function.". This amendment speaks for itself. We are calling for the making of submissions by a local authority to be a reserved function in order that there would be a role for...

Seanad: Foreshore and Dumping at Sea (Amendment) Bill 2009: Committee and Remaining Stages (25 Nov 2009)

Brendan Ryan: In so many ways the Government appears to have little confidence in councillors and has engaged in a long campaign to deprive them of powers using a range of Bills. One small way to reverse that trend would be to provide that, when the local authority is consulted under this section, making submissions would be a matter for councillors, not the manager. I note, however, the Minister of...

Seanad: Foreshore and Dumping at Sea (Amendment) Bill 2009: Committee and Remaining Stages (25 Nov 2009)

Brendan Ryan: I move amendment No. 4: In page 12, line 12, to delete "2005" and substitute "2009". This is a technical amendment that updates the citation of the Harbours Act to reflect the recent Act. Our legal opinion has indicated that it would be possible for the Government to accept the amendment.

Seanad: Foreshore and Dumping at Sea (Amendment) Bill 2009: Committee and Remaining Stages (25 Nov 2009)

Brendan Ryan: I defer to the Minister of State's legal advice on that basis.

Seanad: Foreshore and Dumping at Sea (Amendment) Bill 2009: Committee and Remaining Stages (25 Nov 2009)

Brendan Ryan: Section 28 comes into Part 3. I raise the case of the missing amendment. I understand my party proposed an amendment on this matter on the basis that Part 3 does not have a subject matter or heading. That appears to be a mistake and without precedent. Our amendment was to insert a heading, namely, "Dumping at Sea".

Seanad: Foreshore and Dumping at Sea (Amendment) Bill 2009: Committee and Remaining Stages (25 Nov 2009)

Brendan Ryan: It is a general heading for the sections that commence with section 28.

Seanad: Foreshore and Dumping at Sea (Amendment) Bill 2009: Committee and Remaining Stages (25 Nov 2009)

Brendan Ryan: We submitted it as an amendment but it seems this was not required.

Seanad: Companies (Miscellaneous Provisions) Bill 2009: Second Stage (19 Nov 2009)

Brendan Ryan: I welcome the Minister of State and his officials. This is a short Bill, although the Minister of State spent considerable time setting out the context for its introduction. I was not sure before this morning whether to welcome the legislation and decided to await greater clarity on its purpose. However, the Minister of State did not provide greater detail than that contained in the...

Seanad: Labour Services (Amendment) Bill 2009: Second Stage (17 Nov 2009)

Brendan Ryan: I welcome the Minister of State. I welcome the introduction of the Bill which attempts to deal with the fallout from the FÁS debacle. It would be unfair not to acknowledge that FÁS has had significant successes down through the years as the Minister of State recognised in his speech. The majority of people working in FÁS were not engaged in the high flying junketeering we read about so...

Seanad: Consumer Protection (Gift Vouchers) Bill 2009: First Stage (5 Nov 2009)

Brendan Ryan: I move: That leave be given to introduce a Bill entitled an Act to amend the Consumer Protection Act 2007.

Seanad: Consumer Protection (Gift Vouchers) Bill 2009: First Stage (5 Nov 2009)

Brendan Ryan: I move: "That the Bill be taken in Private Members' time."

Seanad: Consumer Protection (Gift Vouchers) Bill 2009: First Stage (5 Nov 2009)

Brendan Ryan: On Wednesday, 11 November.

Seanad: Education and Training Responses to the Economic Downturn: Statements (5 Nov 2009)

Brendan Ryan: I welcome the Minister of State to the House to discuss this very important matter. We must have a skills drive for people who have lost their jobs and those who may be in vulnerable sectors of the economy. The current financial difficulties, massive unemployment and impending social crisis demand immediate attention and action. Action on reskilling and upskilling of workers must be taken...

Seanad: Order of Business (5 Nov 2009)

Brendan Ryan: I raise a matter that was discussed on "Liveline" yesterday, on which I, as Labour Party spokesperson on consumer affairs, have been working for some time. It is November and with Christmas approaching people are considering gift possibilities. I do not include myself as I am very much a last-minute kind of person. Rather than choosing a gift people may decide to purchase gift vouchers for...

Seanad: Planning and Development (Amendment) Bill 2009: Second Stage (Resumed) (4 Nov 2009)

Brendan Ryan: When the debate adjourned debate last week I was making a point about planning enforcement. I stated that when a planning application is granted with a number of conditions, condition No. 1 is always as follows from Fingal County Council: The development to be carried out in its entirety in accordance with the plans, particulars, specifications, and information lodged with the application,...

Seanad: Industrial Relations (Amendment) Bill 2009: Committee and Remaining Stages (3 Nov 2009)

Brendan Ryan: I move amendment No. 1: In page 7, between lines 31 and 32, to insert the following: "(a) in subsection (1) after "designated for the time being under subsection (3)" to insert: ", and includes a person who was formerly a worker but has ceased to be a worker prior to the making of a claim of breach of the said Acts relating to a period during which the person was a worker",". I welcome the...

Seanad: Industrial Relations (Amendment) Bill 2009: Committee and Remaining Stages (3 Nov 2009)

Brendan Ryan: I thank the Minister of State. Having listened to his comments, I am happy to withdraw the amendment, given the commitment he has given. I hope we will have a successful outcome.
