The contract for the external assisted admissions includes as a minimum requirement that the assisted admission team should comprise at least two skilled mental health professionals, one of whom must be a registered psychiatric nurse, with a minimum of three years' relevant experience working in a mental health setting within the last four years....

Seanad: Health (Miscellaneous Provisions) Bill 2009: Committee and Remaining Stages (8 Jul 2009)

John Moloney: All I can say is that there is legislation dealing with admission procedures, which includes guidelines in this regard. If, for example, the Mental Health Commission has designated a centre as not being fit for purpose, I doubt somebody would be assigned to it, although I am only voicing my own opinion. I find it difficult to believe somebody would be assigned to a centre that was not up to...

Seanad: Health (Miscellaneous Provisions) Bill 2009: Second Stage (2 Jul 2009)

John Moloney: ...I take Senator Bacik's point that miscellaneous provisions in themselves can cater for so many different issues. I will try to deal with as many as possible. I am particularly interested in the mental health provisions of the Bill. I am aware that Members of this and the other House have expressed concerns about the possibility of rushed legislation. The reason for the rush is the High...

Written Answers — Mental Health Services: Mental Health Services (1 Jul 2009)

John Moloney: The Mental Health Act 2001 provides a modern legal framework for the admission and treatment of persons with a mental disorder. The best interests of the person must be the principal consideration in any decisions under the Act, including a decision relating to involuntary admission. The Act has extensive provisions relating to involuntary admissions and provides a high level of protective...

Written Answers — Mental Health Services: Mental Health Services (1 Jul 2009)

John Moloney: I have no plans to introduce any such legislation. The Health Act 2004 provided for the establishment of the Health Service Executive with effect from 1 January 2005 and the Executive was established with its own Vote, Vote 40. The management of funding for mental health services is therefore a matter for the Health Service Executive.

John Moloney: In May 2006 the Government confirmed the decision to develop a new Central Mental Hospital, CMH, at Thornton Hall, County Dublin. Since then, a draft project brief has been prepared and a cost-benefit analysis completed. None of the work undertaken to date has been site specific but a number of difficulties have emerged with the Thornton Hall site. The HSE has identified a need for an...

Mental Health Services. (1 Jul 2009)

John Moloney: ...the meeting in Dundrum at the invitation of Dr. Kennedy some months ago I made it clear that Dundrum would not be a runner. I also made it clear that upon taking up my role in the Department of Health and Children the Minister, Deputy Harney never made an order to me that it had to be Thornton Hall, although I was asked to proceed as quickly as possible with a new central mental hospital....

Mental Health Services. (1 Jul 2009)

John Moloney: ...is not a U-turn. Dr. Kennedy will confirm that I made a visit on my first day in office. I made it clear to him that my instructions were to proceed as quickly as possible to build a new central mental hospital. I told him the only commitment I could give him was that it would not be Dundrum, for many reasons, including the fact that the sale of the property could provide value towards...

John Moloney: The main focus of the Dáil na nÓg 2008 Council was the development of a positive mental health advertising campaign aimed at teenagers. In October 2008, the Office of the Minister for Children and Youth Affairs conducted a series of national consultations with 277 teenagers in six locations around the country in cooperation with the Office for Disability and Mental Health and the HSE's...

I attended the recent launch by the Minister of State, Deputy Andrews, and was pleased to note that for the second year in a...

Written Answers — Departmental Expenditure: Departmental Expenditure (25 Jun 2009)

John Moloney: The Deputy should note that additional funding of €10 million was provided in Budget 2009 for the HSE for disability and mental health to enable these services to be enhanced and strengthened. This funding will allow for the provision of a total of 125 additional therapy posts in the HSE targeted at children of school-going age. 90 of these will be in disability services, including speech...

Health (Miscellaneous Provisions) Bill 2009: Report and Final Stages (24 Jun 2009)

John Moloney: I move amendment No. 1: In page 5, line 16, after "1997," to insert "THE MENTAL HEALTH ACT 2001,". By way of clarification, I take the points made by Deputies Reilly and O'Sullivan. I can understand Deputy Reilly's point about separating mental health from the other health issues generally. However, the complaint is the fact that it is rushed legislation. A full review of the Mental...

Health (Miscellaneous Provisions) Bill 2009: Report and Final Stages (24 Jun 2009)

John Moloney: The 2001 Act provides for the involuntary admission to approved centres of persons suffering from mental disorders and, in addition, the legislation provides that where a person is acutely mentally ill and requires admission to hospital but is unwilling to travel to hospital voluntarily, he or she may be brought to the hospital. Section 13(2) of the 2001 Act places a statutory obligation on...

Health (Miscellaneous Provisions) Bill 2009: Report and Final Stages (24 Jun 2009)

John Moloney: ...against issues coming down the line. I will deal with the issues raised by Deputies. I fully agree with Deputy Jan O'Sullivan that it is a matter of balancing rights and this should be fundamental to any change in legislation, particularly legislation which clearly in some instances was introduced in a hurry. I accept that point and I wish to apologise to the House that consultations...

Health (Miscellaneous Provisions) Bill 2009: Report and Final Stages (24 Jun 2009)

John Moloney: I understand why Members quite properly wish to tease this out. The agency referred to is known as Nationwide Health Solutions. It has not come into existence this week but has been operating since 2006. I confirmed in my earlier response that it depends on protocols. I understand the worry in that regard. However, there is only one agency operating in the country. To remove doubt as to...

Health (Miscellaneous Provisions) Bill 2009: Report and Final Stages (24 Jun 2009)

John Moloney: I will try to clarify the reason for recommittal and for taking these together. The Government decided to bring forward these amendments to the Health (Miscellaneous Provisions) Bill 2009 in order to address the difficulties in the operation of the Mental Health Act 2001. The need to amend the Mental Health Act 2001 arises from the recent High Court proceedings where a patient sought and...
