Vote 29 - Department of Communications, Climate Action and Environment
Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

Catherine Murphy: ...it, as has been said. The ones who are not happy are the ones the Department needs to be talking to. BT was quite forthright in its comments. It said it was seeking fair competition and that Enet should be fully compliant with the rules of state aid approval. It questioned whether state aid approval allows Enet to sell to itself since it is stated specifically that Enet cannot act as...

Public Accounts Committee: Enet (14 Feb 2019)

Catherine Murphy: For the purpose of accuracy, the understanding was that Enet was going to lead the bid all along, and it has changed quite substantially. In actual fact, a number of subcontractors had been named as part of the consortium, which would be the case now, who would be engaged in the building out. The bid has changed very substantially, which was mentioned by others here today. The leadership...

Catherine Murphy: Enet is now a partner as opposed to a main consortium. Was a second pre-qualification test required given that Enet was leading it before?

Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund

Catherine Murphy: Enet is wholesale. Is it appropriate that Enet should have a retail subsidiary called AirSpeed?

Written Answers — Department of Communications, Climate Action and Environment: Broadband Service Provision (15 Jan 2019)

Catherine Murphy: 869. To ask the Minister for Communications, Climate Action and Environment the amount which has been received historically under the revenue share terms with Enet regarding MANs phase 1 concession; the amount Enet has received; and if he will make a statement on the matter. [54338/18]

Public Accounts Committee: Enet (14 Feb 2019)

Catherine Murphy: I seek a clarification because we probably will need to deal with this when we have the Department back in. Who, in the Department, regulates Enet? Does Enet specifically deal with somebody in the Department?

Public Accounts Committee: 2017 Annual Report of the Comptroller and Auditor General and Appropriation Accounts
Vote 29 - Communications, Climate Action and Environment
Broadband Service Provision: Discussion (Resumed)
(28 Mar 2019)

Catherine Murphy: The Analysys Mason report, BT in its response and some of the providers I mentioned were critical of how Enet have managed this in terms of pricing, transparency and a whole range of other things. That is what the report says. Enet has hardly been pristine in how it handled this.

Public Accounts Committee: Enet (14 Feb 2019)

Catherine Murphy: Yes. Before the contracts were extended, there were criticisms from companies which were significant purchasers from Enet. That has been picked up and I hope it will be remedied now and in the foreseeable future. Mr. McCarthy stated that there was a satisfactory relationship between Enet and its customers. However, the customers were saying there were serious problems. Does he accept that?

Public Accounts Committee: Enet (14 Feb 2019)

Catherine Murphy: ..., for example, between different components and whether there were discounts. We have heard from British Telecom, BT, this morning and we can only test this with companies that are purchasing from Enet whether the contract's terms were fully implemented. BT will revert to the committee with a note on the aspects it says were not fully implemented. The purpose of teasing out the...

Public Accounts Committee: 2017 Annual Report of the Comptroller and Auditor General and Appropriation Accounts
Vote 29 - Department of Communications, Climate Action and Environment
Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

Catherine Murphy: Yes. Did Enet apply pressure in 2017? The contract was extended in March 2017, it was bought by the Irish Infrastructure Fund in July 2017 and due diligence was being done. Obviously Granaghan McCourt would have been aware that due diligence was being done because the information would be needed to do that. Was pressure put on the Department? The first contract did not expire until 2019...

Public Accounts Committee: Business of Committee (25 Oct 2018)

Catherine Murphy: Granahan McCourt is the entity behind Enet. Enet was involved in the roll out of broadband in the metropolitan area networks, MANs, of which there are 94 in the country. The original contract was up to 2019 but in 2017 it was extended to 2030 without a tender. Another entity was looking to tender for the contract, prior to it being rolled over. Essentially, I am asking if value for money...

Public Accounts Committee: Business of Committee (27 Sep 2018)

Catherine Murphy: There are two elements to it. One is the fact that Enet was awarded the contract in 2004 and the contract was then extended until 2030 without going back to the market with a tender. Much of what has gone on in relation to the issue is opaque and requires scrutiny. In mid-2017 the infrastructural investment fund invested €200 million in Enet. To be honest, I find that curious given...

Public Accounts Committee: 2017 Annual Report of the Comptroller and Auditor General and Appropriation Accounts
Vote 29 - Communications, Climate Action and Environment
Broadband Service Provision: Discussion (Resumed)
(28 Mar 2019)

Catherine Murphy: Okay, that is fine. The total that the State has spent on MANs so far is €176 million. That was a piece of information given to us by the chief executive officer of Enet. The revenue share represents about 5% of a return over the past 15 years. When we discussed this previously, one of the reasons for not going to tender was because investments were being made by Enet and there was...

Ceisteanna ó Cheannairí - Leaders' Questions (2 Oct 2018)

Catherine Murphy: ...bidding consortium has changed so fundamentally from the initial bid that it is almost unrecognisable from the entity which first entered the process. We had Eir and SIRO exit the process, while Enet remained as the leader of the remaining consortium. In July of this year, SSE pulled out of the consortium. Enet replaced SSE with the State-backed Irish Infrastructure Fund, yet the...

Catherine Murphy: On regulatory oversight, the name "MSE liaison committee" appeared in the Peter Smith report. Is it the de factoregulatory oversight group or what role does it play? Does Enet have any role to play with that body?

Vote 29 - Department of Communications, Climate Action and Environment
Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

Catherine Murphy: I want to come back and clarify a number of things from this morning. Will Mr. Griffin reconfirm that Enet never led the current bid for the national broadband plan?

Public Accounts Committee: 2017 Annual Report of the Comptroller and Auditor General and Appropriation Accounts
Vote 29 - Department of Communications, Climate Action and Environment
Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

Catherine Murphy: I understand that but it should still be possible to get a comparator. The State does not have a stake in Enet. It is the Irish Infrastructure Fund, IIF, that has the stake.
