- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Cost of Insurance Working Group: Minister of State at the Department of Finance (13 Jun 2019)
Anthony Lawlor: The estimated start date of the OLCA has been constantly deferred. There is no guarantee that it will happen in the second quarter of 2019. It is now the second quarter of 2019. There are only a couple of weeks left in the quarter. It is not going to happen in the second quarter of 2019. It has been deferred again.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Cost of Insurance Working Group: Minister of State at the Department of Finance (13 Jun 2019)
Anthony Lawlor: Looking at that I would say the legal profession is doing its damnedest not to provide the information. That is what I gather from the Minister of State's answer.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Cost of Insurance Working Group: Minister of State at the Department of Finance (13 Jun 2019)
Anthony Lawlor: I have a few more queries. The Courts Service was to publish the results of personal injuries claims in a more granular way in its annual report. Has this happened?
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Cost of Insurance Working Group: Minister of State at the Department of Finance (13 Jun 2019)
Anthony Lawlor: Has the Law Reform Commission, LRC, given any indication in its work programme as to when it will publish its findings regarding the capping of damages?
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Cost of Insurance Working Group: Minister of State at the Department of Finance (13 Jun 2019)
Anthony Lawlor: When can we expect to see the introduction of notifications for people against whom claims are made?
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Cost of Insurance Working Group: Minister of State at the Department of Finance (13 Jun 2019)
Anthony Lawlor: I have one more query. I refer to the first report of the Personal Injuries Commission, PIC. Court rules committees are considering its recommendation to amend the relevant court rules in order to require reports to be produced in a standardised format. When will this happen?
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Cost of Insurance Working Group: Minister of State at the Department of Finance (13 Jun 2019)
Anthony Lawlor: The Judicial Council Bill 2017 is coming before the Seanad next week. I am not sure how much of a positive impact this will have on the cost of insurance for ordinary citizens and businesses. It will take time, because it will have to go through the Oireachtas. Then a committee will have to be set up in the Judiciary, which will have a review and will then decide. We could still be...
- Seanad: National Surplus (Reserve Fund for Exceptional Contingencies) Bill 2018: Committee and Remaining Stages (19 Jun 2019)
Anthony Lawlor: This is important legislation which will secure our future, maintain the economic stability that we have brought to the country and protect against potential shocks. I have one quick request for the Minister of State. I ask that the Department, when it is spending this money, would report to the Seanad as well as to the Dáil.
- Seanad: Judicial Council Bill 2017: Report and Final Stages (20 Jun 2019)
Anthony Lawlor: I have a couple of queries because many committees come under the Bill. Will there be enough judges to fulfil all of the committee roles? Will the timescale that the Minister of State outlined for the committees that he is establishing be adhered to? He mentioned six months and said that a number of the committees will be prioritised initially. Some committees should take priority over...
- Seanad: Judicial Council Bill 2017: Report and Final Stages (20 Jun 2019)
Anthony Lawlor: Yes. I appreciate what the Minister of State said. He said that there are 165 judges. In my own area of Naas, one judge has complained that his current workload is excessive, and that is probably the case for many judges around the country. How many judges in total will be on these committees? Is the Minister of State confident that he will get enough judges to fill the committees within...
- Seanad: Judicial Council Bill 2017: Report and Final Stages (20 Jun 2019)
Anthony Lawlor: I congratulate the Minister of State on what he has done. Since his appointment we have had the personal injuries commission report, various legislation, improvements in the Personal Injuries Assessment Board legislation, and this, which is another piece of the jigsaw to help citizens with their insurance payments and reduce the premiums paid by businesses, small enterprises and individuals....
- Seanad: An tOrd Gnó - Order of Business (3 Jul 2019)
Anthony Lawlor: I hope the Leader will facilitate a debate on housing before we break up for the summer recess or as soon as possible after we come back in the autumn. I have an issue concerning the Urban Regeneration and Housing Act 2015, which changed the rules in Part V of the Planning and Development Act 2000 on social and affordable housing. There is now what I call social dumping across many...
- Seanad: An tOrd Gnó - Order of Business (3 Jul 2019)
Anthony Lawlor: It was a cracking game last night.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Insurance Sector: Discussion (4 Jul 2019)
Anthony Lawlor: What is stopping the company from doing that?
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Insurance Sector: Discussion (4 Jul 2019)
Anthony Lawlor: We are not talking about the regulations. It should be proper business practice for a customer of Mr. McGrath's company who has been sued to be given full information regarding the cost associated with his or her premium having increased. That should be standard practice.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Insurance Sector: Discussion (4 Jul 2019)
Anthony Lawlor: I thank the Chairman for allowing me to contribute to this debate on insurance. While I have been here on several occasions for this debate, I am sorry I was not here when the committee heard from the legal profession, as I was in the Seanad Chamber at the time. I welcome the witnesses. They have indicated they comprise only 50% of the industry. It is sad that the other 50% refused to...
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Insurance Sector: Discussion (4 Jul 2019)
Anthony Lawlor: That is fair enough. The sad part of all of this investigation is that one of the sectors responsible for a fair whack of this problem, namely, the judges making awards in the courts, is not here. The book of quantum is based on the historical awards made in the courts. That is one area we cannot investigate but it is a problem.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Insurance Sector: Discussion (4 Jul 2019)
Anthony Lawlor: It would.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Insurance Sector: Discussion (4 Jul 2019)
Anthony Lawlor: That would be excellent. I thank the Chairman for accommodating that. As most people know, there are many legs to this stool, one of which we have here today. Will each company indicate how many levies are paid per €100 of a premium? They have gone through all the costs but nobody has indicated how much the Government levies come to?
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Insurance Sector: Discussion (4 Jul 2019)
Anthony Lawlor: Can the companies indicate how much per €100 of a premium is a levy?
