- Seanad: Pharmacy Bill 2007: Committee Stage (Resumed) and Remaining Stages (22 Mar 2007)
Fergal Browne: I thank the Minister and her officials. We support the Bill in general and we welcome the fitness to practise aspect of the Bill which we hope will ensure patient safety. Fine Gael is very keen to have a patient safety authority to cover all areas of medicine as there is a need for such a body. I do not envy the Pharmaceutical Society of Ireland because it will have a lot of work to do...
- Seanad: Order of Business (27 Mar 2007)
Fergal Browne: It is like the Fianna Fáil Party manifesto.
- Seanad: Order of Business (27 Mar 2007)
Fergal Browne: I agree with previous speakers with regard to Northern Ireland. Politics has won out and the one thing we can all learn is that violence led to nowhere except to polarisation. It will be remembered that, unfortunately, thousands of people paid with their lives during the Troubles. I was born in the same year as the Sunningdale Agreement. I often wonder why we are only reaching this point...

- Seanad: Health Bill 2006: Committee Stage (27 Mar 2007)
Fergal Browne: I move amendment No. 7: In page 13, subsection (1)(i), line 41, after "population" to insert the following: "in terms of the provision and delivery of services and the regulation ofâ (i) the demand for, (ii) supply of, and (iii) number of, residential places throughout the State". We propose this amendment because the Bill does not go far enough in specifying the centres that will be under...
- Seanad: Health Bill 2006: Committee Stage (27 Mar 2007)
Fergal Browne: I move amendment No. 8: In page 15, before section 10, to insert the following new section: 10.âIn any investigation under section 9â (a) the report of the investigation shall be absolutely privileged, (b) due process and fair procedures shall be observed, (c) any person called to give evidence, shall be allowed legal representation if he or she so requests, and there shall be a duty on...
- Seanad: Health Bill 2006: Committee Stage (27 Mar 2007)
Fergal Browne: While I am not suggesting elected representatives should be on the board, it is not necessary to specify their exclusion in legislation. There is no crime in being a politician. The same applied with the Pharmacy Bill last week. I would love to see a court challenge under equality legislation, as I am sure the courts might take a different view on the matter. This unnecessary provision...

Fergal Browne: And doing an excellent job.

- Seanad: Health Bill 2006: Committee Stage (27 Mar 2007)
Fergal Browne: We will all be going before the electorate in July, apart from Senator Henry who has sense.
- Seanad: Health Bill 2006: Committee Stage (27 Mar 2007)
Fergal Browne: Senator Dardis could be back again, no doubt. If I fail to be elected, I can then join the boards of such bodies, although I was not chosen by the people. Yet elected candidates who receive a public mandate are excluded from membership of such bodies. It is nonsensical.
- Seanad: Health Bill 2006: Committee Stage (27 Mar 2007)
Fergal Browne: I move amendment No. 10: In page 31, subsection (2), line 27, to delete "Authority" and substitute "Minister". We believe the Minister, not the authority, should appoint the chief inspector.
- Seanad: Health Bill 2006: Committee Stage (27 Mar 2007)
Fergal Browne: I wonder if subsection (3) of section 42 is somewhat vague. It would be very easy for the chief inspector to refuse to answer questions on difficult topics if legal cases are pending but these are the topics that will be raised at meetings. Easy questions will not be raised at committees, even if the chief inspector is before the Oireachtas Joint Committee on Health and Children or a...
- Seanad: Order of Business (28 Mar 2007)
Fergal Browne: I second Senator Burke's amendment to the Order of Business. I ask that the Minister for Justice, Equality and Law Reform be asked to come to the House in the dying days of the Seanad to discuss the issue of the Director of Public Prosecutions who can be slow to progress cases. On Pat Kenny's radio show many victims expressed their frustration. In some instances their cases were not heard....
- Seanad: Order of Business (28 Mar 2007)
Fergal Browne: Concerning the car crashes yesterday, I compliment the role of radio in alerting motorists to the problem, in particular local radio stations which played a key role in what was a tricky situation. I compliment also all the off-duty emergency personnel who came to work on their day off to help in the crisis.
- Seanad: Order of Business (28 Mar 2007)
Fergal Browne: It said it brought competition to the mobile market.
- Seanad: Order of Business (Resumed) (29 Mar 2007)
Fergal Browne: Given the Acting Leader's experience of agriculture, will he press the Minister for Agriculture and Food to put pressure on Greencore to drop its case against the beet growers? I note the company has resolved its difficulties with the former workers, in particular in Mallow, which is welcome. It is time to take this matter a step further. The beet growers are due to receive compensation in...
