- Questions on Proposed Legislation (22 Nov 2016)
Michael Moynihan: This issue has erupted regarding Kerry Group shares. It is widely known in the agriculture industry how farmers dealt with Kerry Group. Recently, 400 farmers have been given notice from the Revenue Commissioners of tax demands going back three, four or five years. These tax demands are on farmers who have had a desperately difficult year. It is widely known they will not be able to pay...
- Other Questions: Rural Social Scheme (22 Nov 2016)
Michael Moynihan: There is some indication from the groups that the criteria for the scheme will be changed. A person on farm assist who qualified for the rural social scheme would stay on that scheme for a number of years but now it seems there is a cap of three years, after which people have to break of three years before returning to it. It is almost like a CE scheme and this could be detrimental to the...
- Topical Issue Debate (Resumed): Tax Code (23 Nov 2016)
Michael Moynihan: I thank the office of the Ceann Comhairle for allowing Deputies to raise this matter. Approximately 400 farmers received a letter from the Revenue Commissioners yesterday on shares issued by Kerry Co-op. I understand Revenue has been through the mill on co-op shares which it refused to accept as income, determining instead that they were subject to capital gains rather than income tax when...
- Topical Issue Debate (Resumed): Tax Code (23 Nov 2016)
Michael Moynihan: I thank the Minister of State for the reply. It states, "Farmers who were tax compliant and disclosed the value received will therefore not be facing any additional income tax." As I understand it, all farmers declared the shares in their tax returns and have done so for a long time. It is bordering on insulting to use the line I have quoted. All the farmers were declaring the shares to...

- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Taxation Matters Relating to Kerry Co-Operative: Revenue Commissioners. (7 Dec 2016)
Michael Moynihan: I thank the Chairman for allowing Members of the Oireachtas who are not members of the committee to contribute and I thank the Revenue Commissioners. My colleagues have put the case very strongly. This is a fundamental issue in the farming community and for the recipients of the 400 letters sent out in November. There can be no disputing that the wording of the letter was very...
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Taxation Matters Relating to Kerry Co-Operative: Revenue Commissioners. (7 Dec 2016)
Michael Moynihan: Am I correct that an appeal has been lodged with the Tax Appeals Commission in relation to a determination by the Revenue Commissioners that co-operative shares sold are liable to capital gains tax rather than income tax but which the shareholder believes are liable to income tax rather than capital gains tax?
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Taxation Matters Relating to Kerry Co-Operative: Revenue Commissioners. (7 Dec 2016)
Michael Moynihan: That case exists. The Revenue Commissioners made a determination in relation to co-operative shares that were sold and that determination is currently before the Tax Appeals Commission yet Mr. Walsh says he is not aware of it and that Revenue stands over what it is pursuing in this.
