- Select Committee on Justice and Equality: Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Bill 2022: Committee Stage (21 Feb 2023)
Pa Daly: I move amendment No. 42: In page 10, to delete lines 22 and 23 and substitute the following: “of persons on account of their membership or presumed membership of a group defined by reference to protected characteristics (within the meaning of section 7 or 8, as the case may be), or any one of those characteristics,”.
- Select Committee on Justice and Equality: Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Bill 2022: Committee Stage (21 Feb 2023)
Pa Daly: I move amendment No. 43: In page 11, to delete lines 1 to 9 and substitute the following: “(a) prepares or possesses material which is threatening, abusive or insulting that is likely to incite violence or hatred against a person or a group of persons on account of their protected characteristics or any of those characteristics with a clear and serious intention of communicating...
- Select Committee on Justice and Equality: Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Bill 2022: Committee Stage (21 Feb 2023)
Pa Daly: We discussed this matter with certain groups and individuals and it is believed that it constitutes an undue interference with the right to private life and does not meet the criminal standard of proof with regard to the intention side of things.
- Select Committee on Justice and Equality: Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Bill 2022: Committee Stage (21 Feb 2023)
Pa Daly: Can I also speak to that amendment?
- Select Committee on Justice and Equality: Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Bill 2022: Committee Stage (21 Feb 2023)
Pa Daly: If you consider amendment No. 55 in the context of section 18 and the proposed insertion of section 6A after section 6 of the Criminal Justice (Public Order) Act 1994, you could have a situation, and I have dealt with many over the years, where the row is not necessarily started by the person who gets charged but he, or perhaps the other person, is charged. Somebody could start a row but...
- Select Committee on Justice and Equality: Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Bill 2022: Committee Stage (21 Feb 2023)
Pa Daly: I will follow on from the Minister's reply. He mentioned that this provision would be subject to the DPP's processes but most public order offences are dealt with by a local superintendent who makes the decision. Is every case going to go to the DPP then if there is a hate crime? No. It will be the superintendent who will decide rather than the DPP.
- Select Committee on Justice and Equality: Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Bill 2022: Committee Stage (21 Feb 2023)
Pa Daly: My concern is that it digs right down into some of the most minor of offences such as public order offences. While it might very well be a public order offence, it would specifically label a person as a hate crime offender, for example, in a row that a person did not start. That might be a bit much.

- Written Answers — Department of Housing, Planning, and Local Government: Housing Schemes (28 Feb 2023)
Pa Daly: 274. To ask the Minister for Housing, Planning, and Local Government his views on the ineligibility of those on a widow’s pension, rather than a State pension, for the tenant purchase scheme; and if he will outline any plans he has to reform this anomaly. [9670/23]

Pa Daly: 291. To ask the Minister for Housing, Planning, and Local Government the number of voids brought back into the housing stock in the year 2022; and the number of these that were previously vacant for longer than six months, in tabular form, broken down by local authority. [9933/23]
- Ceisteanna ar Pholasaí nó ar Reachtaíocht - Questions on Policy or Legislation (1 Mar 2023)
Pa Daly: Eligibility for the tenant purchase scheme has evolved over the years and continues to evolve. However, a widow recently contacted me to say she had made an application to purchase the house she has lived in for the past 30 years, after she lost her husband, only to be told that, because she is on a widow's pension, she is excluded from the scheme because a State pension is regarded as...
- Employment Equality (Pay Transparency) Bill 2022: Second Stage [Private Members] (2 Mar 2023)
Pa Daly: I move: "That the Bill be now read a Second Time." A couple of years ago a good old friend and colleague came to me with a story of her friend, Mike. He had got first class honours as a mature student when he returned to college and a job came up in Dublin, to where he travelled, at his own expense, only to discover when he arrived for the interview that the rates of pay would be far less...
- Employment Equality (Pay Transparency) Bill 2022: Second Stage [Private Members] (2 Mar 2023)
Pa Daly: I thank the Minister for the fact the Bill is unopposed. We are open to working with him and with any of the other Senators who are working on this issue. In my own experience at work, although I did not do very many employment law cases, anyone who came in with a problem in the workplace was not unionised and they had been messed around because there was no backup for them in the...
- Select Committee on the Irish Language, the Gaeltacht and the Irish Speaking Community: Meastacháin le haghaidh Seirbhísí Poiblí 2023
Vóta 33 - An Ghaeltacht (Athbhreithnithe) (1 Mar 2023) Pa Daly: Fearaim fáilte roimh an Aire Stáit dá chéad chruinniú anseo agus tá súil agam go mbeimid ag obair le chéile i rith na bliana seo chugainn. Tá ceist ghairid agam dó mar gheall ar Údarás na Gaeltachta. Tá súil agam go mbeidh toghchán ag teacht an bhliain seo chugainn. Feicim go bhfuil méadú sa...

Vóta 33 - An Ghaeltacht (Athbhreithnithe) (1 Mar 2023) Pa Daly: Bíonn an tAire Stáit ar Radio Kerry níos minice ná mise.
- High Energy Costs: Motion [Private Members] (7 Mar 2023)
Pa Daly: The impact of the energy crisis in my constituency in County Kerry has been far reaching. Average gas and electricity prices have doubled in the past two years. The number of households in energy poverty has increased by 29% and all the time, the Government refused to reduce and cap energy prices, or introduce the windfall tax. The result has been that older people are in the dark;...
- Saincheisteanna Tráthúla - Topical Issue Debate: Medical Cards (8 Mar 2023)
Pa Daly: Chomh maith leis an Teachta McHugh, gabhaim comhghairdeas le gach duine mar gheall ar International Women’s Day. Téann a lán daoine gach bliain, nó gach seachtain, ag iarraidh freagraí dá ngearán leighis. Faigheann siad endoscopies agus colonoscopies chun freagraí a fháil dóibh féin. Sna laethanta roimh na mion-obráidí...
- Saincheisteanna Tráthúla - Topical Issue Debate: Medical Cards (8 Mar 2023)
Pa Daly: I thank the Minister of State for the clarity she provided. We all have jobs to do from here on in, the first of which will be to engage with doctors who are prescribing these medications in order to ensure that if other medications are on the list, people, particularly medical card patients, will be directed to those ones. We must also engage with the companies if there is an easy fix in...
