Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: I ask Senator Bannon to withdraw his comment.

Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: There is decorum in this House. The Senator made an allegation against the Minister which was unfair and unfounded.

Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: Does the Senator want to repeat it?

Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: He accused the Minister of being cowardly.

Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: I do not believe it is very fair or honourable of Senator Bannon.

Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: I am sorry, but it is not a matter for the Minister to decide. The Chair believes it is an unfair comment to make to a member of the Cabinet. It is incorrect and Senator Bannon should withdraw it, in fairness. He made a statement to the effect that the Minister was cowardly. That is not fair and he should withdraw the allegation.

Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: That is an unfair comment to make against a Minister, in particular this Minister. It is up to the Senator.

Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: On reflection, I believe the comment is not justified and the Senator should withdraw it.

Seanad: Anti-Social Behaviour: Motion. (11 May 2005)

Terry Leyden: If the Senator is not prepared to withdraw it, that is fair enough.

Seanad: Order of Business. (12 May 2005)

Terry Leyden: I commend the Garda Commissioner, Noel Conroy, and the force on their vigilance and on their proposal for a clampdown on road traffic offences this weekend to address the significant loss of life on our roads. I call on the Leader to schedule a further debate on road safety and on what other steps can be taken in this regard. I hope this will be a golden weekend in Ireland with no fatalities....

Seanad: Order of Business. (17 May 2005)

Terry Leyden: Although I do not know how serious are the proposals, I wish to raise the proposed €10 travel tax which some mad Eurocrat has brought forward to try to solve the Third World aid issue. Indeed, John O'Shea of Goal has condemned this proposal as absolutely ridiculous. As an island nation, we need air travel. The imposition of further taxation would be a major blow to this country. Whoever...

Seanad: Safety, Health and Welfare at Work Bill 2004: Committee Stage. (17 May 2005)

Terry Leyden: Will the Minister of State elaborate further in regard to the delegation or transfer of responsibilities? He used the example of the railways. Will the amendment allow for the delegation of responsibility to other organisations or will the airport authority have responsibility, for example, for rail and bus services?

Seanad: Safety, Health and Welfare at Work Bill 2004: Committee Stage. (17 May 2005)

Terry Leyden: I commend Senator O'Toole on raising this issue, which appears to require that a significant number of letters be written. There will be no evidence for the receipt of such communications. If letters are to be written, they should be registered in order to guarantee their receipt. It might be claimed that a letter has been sent but not received. New communications technologies, such as...

Seanad: Safety, Health and Welfare at Work Bill 2004: Committee Stage. (17 May 2005)

Terry Leyden: I thank the Minister of State and his staff for alerting the House to this particular situation regarding the new European directives. However, a provision could be included in the Bill so it would also comply with all European directives. So much comes out of the European institutions that it is difficult to ensure that Bills remain relevant all the time. I do not know if the Minister of...

Seanad: Safety, Health and Welfare at Work Bill 2004: Committee Stage. (17 May 2005)

Terry Leyden: We must do so. We might have a constitutional issue. In any event, this Bill was in circulation for some time, these new regulations were introduced and they have now been included in the Bill itself, which I commend. However, other ones may arrive in the next weeks and it is difficult to keep the Bill up to date. That is my point.

Seanad: Safety, Health and Welfare at Work Bill 2004: Committee Stage. (17 May 2005)

Terry Leyden: Next Tuesday, 24 May, subject to availability. I thank the Minister of State and his officials for guiding this Bill through the House. It shows the Minister of State's confidence and knowledge of this particular Bill that he was prepared to listen to amendments from all sides of the House and to amend the Bill accordingly. In the circumstances, I thank him for bringing the Bill this far and...

Seanad: Registration of Wills. (17 May 2005)

Terry Leyden: I raise the need for the Minister for Justice, Equality and Law Reform to review the procedures governing the making of wills and the desirability of providing a national registration system for wills. I am of the opinion there is an urgent need for legislation to provide for a national registration system for wills. We are faced with a situation in which many people's last wills are not...

Seanad: Registration of Wills. (17 May 2005)

Terry Leyden: This is the advantage of being legislators. We have a responsibility, in co-operation with the Government, to introduce legislation but we have a right to introduce our own when we see a shortfall. This has been done in the past by other Members of the House in connection with important Bills. The bones of this Bill are set out in the Council of Europe's convention but I have added other...

Seanad: Registration of Wills. (17 May 2005)

Terry Leyden: I thank the Minister of State for coming here on behalf of the Minister for Justice, Equality and Law Reform. This is one of the most comprehensive replies ever given in the Seanad. Prior to raising this matter, the Minister was not aware of the issues I have brought to his attention, particularly in regard to the Council of Europe documentation. I have solved the registration problem by...
