Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (16 Nov 2016)

Alan Farrell: In the context of that communication I referenced earlier between Mr. McGuinness's staff and that of Peter Robinson, in September 2013, there was communication between Richard Bullock and Vincent Parker relating to communications between Mr. McGuinness and the First Minister regarding PIMCO. A conference call took place a number of months later. To my knowledge, the conference call that...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (16 Nov 2016)

Alan Farrell: I could be corrected. We can check the record. It is probably not significant but I think Mr. McGuinness said that it was not significant enough to be brought to his attention.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (16 Nov 2016)

Alan Farrell: I suppose this goes to the core of the slight difficulty I have with Mr. McGuinness's assertions in his statement and the comments he made previously in Northern Ireland. The idea that something as critical as this would be given to a person with vast experience in a political party such as Mr. McGuinness's party, which is well known for being rather precise in its communication methods, who...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (16 Nov 2016)

Alan Farrell: Sure.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (16 Nov 2016)

Alan Farrell: The only other question I have concerns Peter Robinson. I appreciate the difficulties he has. I think it is unfortunate that he has not submitted to the Committee of Public Accounts purely to put his point across. We want to hear from him. We have invited him to attend the committee. I accept he claims he did not get the invitation but he is certainly aware of it now. There will be no...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (16 Nov 2016)

Alan Farrell: That is beyond our scope.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (16 Nov 2016)

Alan Farrell: It goes to the whole basis of the requirement to have Mr. Peter Robinson before the committee.

Local Government Reform (Amendment) (Directly Elected Mayor of Dublin) Bill 2016: Second Stage [Private Members] (22 Nov 2016)

Alan Farrell: I thank Deputy Lahart for brining forward this Bill. Critical to this debate is the amendment the Minister of State has tabled. It gives us an opportunity not only to tease out the specifics of the role we would like the directly elected mayor to have but also to ensure we are not just talking about Dublin. As a former mayor of Fingal, whose local authority was responsible for derailing...

Local Government Reform (Amendment) (Directly Elected Mayor of Dublin) Bill 2016: Second Stage [Private Members] (22 Nov 2016)

Alan Farrell: Indeed. That is probably true. The truth is that we have to resource mayors properly and give them the responsibility and - dare I say it, unpopularly perhaps - the remuneration to ensure they have a full-time job that keeps them engaged with their local community and that they can make a career out of it. Let us be honest about the fact that, across all sides of the House, we recognise...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: Can Mr. Stewart give more detail on the technical breaches to which he referred? Perhaps he could circulate a copy of the letter.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: Mr. Stewart repeatedly used the term "technical" but I do not think it is technical. It is a direct breach of the NDA.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: It is clear that further direct breaches may come to light if Mr. Neporent is to continue on the course of action he outlined in the letter. It would be prudent either for the committee to correspond with Mr. Neporent to establish when those particular findings were made or for NAMA to provide the committee with his further responses. It would be helpful, although we have a limited timeframe.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: In Mr. Neporent's response he referenced the fact that he believed there would be no material impact on the bidding process. I am not entirely convinced that he would be able to answer that question.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: That is appreciated and I look forward to NAMA's response in due course. However, I highlight the fact that the clock is ticking. I appreciate that NAMA is not going to provide information for us from its own files and that is up to Mr. Neporent to do so. That is noted. Last week in his opening statement and during his contributions Mr. Neporent referred to an outstanding fee due to NAMA...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: I apologise for missing it.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: No, it is not. Does Mr. McDonagh have any thought on it?

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: Given the nature of the information, as well as the value, the size and number of the assets provided for Cerberus and any other bidder for that matter, for it to then suggest €20 million worth of assets did not exist is quite remarkable. I know that Cerberus has withdrawn this counterclaim. However, it had emanated from a thought process in New York over time. What was the nature...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

Alan Farrell: Okay, Mr. McDonagh's explanation is sufficient.

Select Committee on Justice and Equality: Business of Select Committee (30 Nov 2016)

Alan Farrell: This is my second term on this committee and for the information of my colleagues, I have never come across a Bill from an Opposition Member getting such support within the committee and from the Minister and I have never seen a Private Member’s Bill not go through pre-legislative scrutiny since that process was introduced in the last Dáil. The Chairman has been here much longer...

Select Committee on Justice and Equality: Estimates for Public Services 2016
Vote 20 - An Garda Síochána (Supplementary)
Vote 22 - Courts Service (Supplementary)
(30 Nov 2016)

Alan Farrell: The Minister is very welcome. I thank her for her presentation. I have a couple of questions on a couple of line items and then some comments. Is the Department of Justice and Equality responsible in any way through its budget for Oberstown?
