An Bille um an gCeathrú Leasú is Tríocha ar an mBunreacht (Uimh. 3) 2014: An Dara Céim [Comhaltaí Príobháideacha] - Thirty-fourth Amendment of the Constitution (No. 3) Bill 2014: Second Stage [Private Members] (18 Nov 2014)

Éamon Ó Cuív: Tá sé breagach. The Government was going to sell it off. Sinn Féin was right to have this debate tonight. The debate on water proposals should have taken place over the past week. There is no point in the Government's coming to the House tomorrow, putting a proposal and stating that we can debate it all we like but not as much as a full stop will be changed. That is a...

Éamon Ó Cuív: It will be interesting to see what the next idea on privatisation will be. The Government should put its money where its mouth is. If it does not do so, we will have to cement a provision in the Constitution, although it might be difficult enough to find the proper wording. It can be done none the less. We should agree tonight to support the thrust of the Sinn Féin Bill, as Second...

Éamon Ó Cuív: No; I am referring to publicly owned water services. That is why I stated that finding the wording could be difficult. I would argue with the wording of the proposed amendment but not the principle. We all know the principle, and if we could agree on it we could find a suitable way of wording the amendment. The challenge has been left to the Minister. Tomorrow the Government will do a...

Written Answers — Department of Justice and Equality: Prisoner Privacy (18 Nov 2014)

Éamon Ó Cuív: 119. To ask the Minister for Justice and Equality when she will set up an inquiry into the leak of confidential information regarding a visit made by this Deputy to Limerick Prison on 30 October 2014; her views that it acceptable that such a breach of confidentiality took place contrary to the Official Secrets Act; the steps she will take to prevent a recurrence; and if she will make a...

Written Answers — Department of Agriculture, Food and the Marine: Agriculture Schemes Eligibility (18 Nov 2014)

Éamon Ó Cuív: 220. To ask the Minister for Agriculture, Food and the Marine if a person (details supplied) in County Galway whose entitlements were reinstated in 2013 will be entitled to entitlements from 2015 to 2020, taking account that no single payment claim was made in 2013 due to force majeure; or alternatively if the person in question will be automatically allocated entitlements from the national...

Water Sector Reforms: Motion (Resumed) (19 Nov 2014)

Éamon Ó Cuív: We need to examine the facts in a calm way. I am disappointed that the Minister is leaving, but so be it. I often wonder does anyone listen in this House. I have made comment previously to the effect that it would be almost as well to put the contributions up on the web and not bother coming to the House in order that we could save ourselves a good deal of time. If the Dáil is to...

Water Sector Reforms: Motion (Resumed) (19 Nov 2014)

Éamon Ó Cuív: There will be a net contribution of between minus €20 for a single dwelling house and plus €30 in rural Ireland. Am I correct?

Water Sector Reforms: Motion (Resumed) (19 Nov 2014)

Éamon Ó Cuív: We are trying to be constructive tonight. When one tries to be constructive around here, one gets into trouble. The Ministers of State were trying to be helpful to me. We would not like to make a mistake. I think by the nodding heads, my sums are right. These 500,000 houses will yield damn all to the Exchequer. However, to get this null or minor sum will require a huge amount of...

Water Sector Reforms: Motion (Resumed) (19 Nov 2014)

Éamon Ó Cuív: What is the gain here in that case? What are we getting out of this apart from one thing that always happens. I am willing to admit I saw it happen when we were in government. There is a thinking in officialdom, which will wait 50 years to get its way eventually. I see it doing things with this Government that were tried a few times with me, although I said "No". Officialdom will keep...

Written Answers — Department of Agriculture, Food and the Marine: Agriculture Schemes Eligibility (19 Nov 2014)

Éamon Ó Cuív: 66. To ask the Minister for Agriculture, Food and the Marine if farmers who have completed relevant courses in Northern Ireland, achieving agricultural qualifications, will have these qualifications recognised automatically on a like for like basis when applying for the various schemes and tax breaks that require agricultural qualifications in this jurisdiction; and if he will make a...

Éamon Ó Cuív: 67. To ask the Minister for Agriculture, Food and the Marine when farmers who have applied for forestry grants and were awaiting assessment of the possible effects of afforestation on the hen harrier habitats will be issued with a decision on their applications; the reason for the delay in this matter; and if he will make a statement on the matter. [44408/14]

Written Answers — Department of Agriculture, Food and the Marine: Agri-Environment Options Scheme Payments (19 Nov 2014)

Éamon Ó Cuív: 75. To ask the Minister for Agriculture, Food and the Marine when agri-environment options scheme payments for 2014 will issue; and if he will make a statement on the matter. [44508/14]

Written Answers — Department of Environment, Community and Local Government: Illegal Dumping (19 Nov 2014)

Éamon Ó Cuív: 168. To ask the Minister for Environment, Community and Local Government the steps taken by his Department to ensure that material dumped without permission in the river Corrib at the Old Dock on Long Walk, Galway city is removed; and if he will make a statement on the matter. [44406/14]

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Finance: Finance Bill 2014: Committee Stage (Resumed) (19 Nov 2014)

Éamon Ó Cuív: I can only look at the words in front of me, I cannot look at what people might think the words mean. The Minister will agree that legislation means what it means as written. What it says here is "spends not less than 50% of that individual's normal working time farming land". Now if the person is working 40 hours a week, then he has to spend 20 hours on the farm. If he normally works 50...

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Finance: Finance Bill 2014: Committee Stage (Resumed) (19 Nov 2014)

Éamon Ó Cuív: If they were Deputies it would be an understatement of a normal working week. They would have to accept the facts.

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Finance: Finance Bill 2014: Committee Stage (Resumed) (19 Nov 2014)

Éamon Ó Cuív: I do not have any land.

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Finance: Finance Bill 2014: Committee Stage (Resumed) (19 Nov 2014)

Éamon Ó Cuív: The second question that arises here is that in order to pass this test do we move to the other two tests? Under this test, one has to put in 20 hours on the farm.

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Finance: Finance Bill 2014: Committee Stage (Resumed) (19 Nov 2014)

Éamon Ó Cuív: Well, 20 hours is 20 hours. There are farms in the west where that time would be hard to justify if one were to farm efficiently. My experience was that part-time farmers in the west sometimes ran their farms a lot more efficiently than those who were full-time because they had the resources to do so. In other words, the ideal way of getting a family income was to have a job off the land...

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Finance: Finance Bill 2014: Committee Stage (Resumed) (19 Nov 2014)

Éamon Ó Cuív: It refers to an "individual's normal working" week. It does not refer to "a normal working" week. People use certain wording for a reason. If this referred to "50% of a normal working week", I would see it as being specifically 20 hours. The Bill refers to an individual's "normal working time".

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Finance: Finance Bill 2014: Committee Stage (Resumed) (19 Nov 2014)

Éamon Ó Cuív: If an individual's normal working week is more than 40 hours, it would appear to have an effect.
