- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: To any of the speakers. Every case is different and people can be convicted of manslaughter. Are we saying that the battered wife loses her house and everything else?
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: That is a good summary. It would be helpful but I do not think it is a panacea for many of the problems that are there. I want to refer to some of the technical points. When would the joint tenancy be severed? Is it severed as soon as somebody is charged with the offence or when they are convicted? What is the threshold for when that happens?
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: Is there not a problem with assuming guilt and effectively stripping an asset from somebody who might be found innocent later on? Does that put the property into a-----
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: What happens if nobody makes an application to the court to determine whether the tenancy should be severed?
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: What happens then?
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: If nobody brings an application, nothing happens.
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: There is no impact.
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: It is important. We might think it is going to be held up in trust for years, with the children not being able to access it. It is an interesting point.
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: I would put it to Mr. Byrne that it is not. It has happened because the people were connected legally and there is a joint ownership. It was their relationship that gave them the ownership because they jointly owned the property. In the tragic case of Mr. Byrne's brother, for example, if the separation had been completed we would not be here talking about this at all because the legal...
- Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of the Civil Liability (Amendment) (Prevention of Benefits from Homicide) Bill 2017 (27 Mar 2019)
Clare Daly: I do not think anybody is assuming that. It is more a case of while a couple is legally connected then the share of the estate is each individual's bit, until they separate. Had the separation or divorce been completed we would not be having this conversation. I believe that Professor Mee wanted to come in on that also.
- Ceisteanna - Questions - Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Child Protection (28 Mar 2019)
Clare Daly: 5. To ask the Minister for Children and Youth Affairs the actions she will take to act on the recommendations of the UN special rapporteur regarding the sale and exploitation of children and the culture of silence here in relation to issues of childhood sexual abuse and exploitation in particular the recommendation for a dedicated and integrated strategy to respond to sexual violence against...
- Ceisteanna - Questions - Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Child Protection (28 Mar 2019)
Clare Daly: My question relates to the damning recommendations of the United Nations special rapporteur regarding the sale and exploitation of children. I refer in particular to the whole area of the culture of silence around these issues. I am thinking particularly about the recommendation for a dedicated and integrated strategy to respond to sexual violence. I have asked the Minister a number of...
- Ceisteanna - Questions - Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Child Protection (28 Mar 2019)
Clare Daly: In fairness, it was an excellent report and perhaps we should be looking for more time in the Chamber to discuss some of these issues. I acknowledge, as the special rapporteur does also, that there have been measures implemented, particularly in respect of preventing and responding to abuse now. Progress has been made in this area and that is a fact. I am glad to see the Minister has...
- Ceisteanna - Questions - Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Child Protection (28 Mar 2019)
Clare Daly: The problem is urgency. The point was made. Those involved were critical of the remit of the mother and baby homes commission not being broad enough to deal with the illegal adoption issue. While it is welcome that the Minister might have the report in April, we need to be moving to implement its findings. The probe was clear in respect of the culture of silence and the prevention of...
- Sea-Fisheries (Amendment) Bill 2017: Second Stage (28 Mar 2019)
Clare Daly: The Minister has repeatedly said that the Bill simply reinstates the position that pertained up to 2016, so in other words, it is no big deal. However, I am one of the many Deputies who vehemently disagree with that position and believe this is a very dangerous Bill. As other Deputies have said, nobody in here has any massive objection to Northern Irish fishermen getting access to our six...
- Sea-Fisheries (Amendment) Bill 2017 [Seanad]: Committee and Remaining Stages (28 Mar 2019)
Clare Daly: That is exactly the point I want to address and the purpose of the amendments. There is a big difficulty in that it is almost impossible to define accurately what constitutes being "owned and operated" in Northern Ireland. We cannot be specific about what is a Northern Irish vessel. As the vessels are registered in the United Kingdom, there is no clear Northern Irish designation. Leaving...
- Sea-Fisheries (Amendment) Bill 2017 [Seanad]: Committee and Remaining Stages (28 Mar 2019)
Clare Daly: The Minister stated that he thinks there is a register and that they have told him-----
- Sea-Fisheries (Amendment) Bill 2017 [Seanad]: Committee and Remaining Stages (28 Mar 2019)
Clare Daly: Okay, but the key point is that there is nothing to stop a Scottish boat putting Coleraine down as a port on the register. What level of detail has the Minister seen from the Northern Ireland register? This is a fundamental point. We do not know what we are being asked to open ourselves up to here or what might be the levels of exploitation. Why are we rushing this legislation through...
- Sea-Fisheries (Amendment) Bill 2017 [Seanad]: Committee and Remaining Stages (28 Mar 2019)
Clare Daly: I move amendment No. 4:In page 3, line 17, after “Ireland” to insert “by persons resident in Northern Ireland or the Republic of Ireland”.
- Written Answers — Department of Children and Youth Affairs: Child Detention Centres (28 Mar 2019)
Clare Daly: 28. To ask the Minister for Children and Youth Affairs if she is satisfied that the non-publication of a report is in the best interests of the children in view of the fact that the authors of the report (details supplied) made a safeguarding referral during their visit to Oberstown Children Detention Campus on the basis of child welfare concerns.
