Public Accounts Committee: 2017 Annual Report of the Comptroller and Auditor General and Appropriation Accounts
Vote 29 - Department of Communications, Climate Action and Environment
Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

David Cullinane: We had the Secretary General of the Department of Social Protection before the committee and he, helpfully, reminded me that bogus self-employment is illegal. At what point did the Department of Communications, Climate Action and Environment or has the Department ever become aware about the potential for illegal or bogus self-employment contracts in RTÉ?

Vote 29 - Department of Communications, Climate Action and Environment
Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

David Cullinane: When one has either service level or oversight agreements in place then one must make sure that there is a level of oversight above the organisation, and in this case, it is RTÉ. Given that we had a report, which identified that there may be a problem, and given that we know that it is illegal to operate bogus self-employment, there would be an obligation on Accounting Officers and...

Vote 29 - Department of Communications, Climate Action and Environment
Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

David Cullinane: Why not? I was taken to task by the Secretary General of the other Department who said that it was illegal, and if any official was aware of bogus self-employment then he or she would be obliged to report as it is an illegal practice.

(6 Dec 2018)

David Cullinane: Has the Department of Communications, Climate Action and Environment sought to establish that?

(6 Dec 2018)

David Cullinane: There has been an outcome as Eversheds has produced a report. I am trying to establish what kind of relationship exists between the Department of Communications, Climate Action and Environment, and RTÉ in terms of this matter. Mr. Griffin seems to be saying that it is up to RTÉ to deal with the matter and he does not envisage his Department playing a role, which might be the case.

Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

David Cullinane: That is fair enough. I am unsatisfied with the responses made by RTÉ and we will go back to it again. RTÉ was to meet all of the workers affected by this matter. Some of the workers have contacted me, and perhaps they have contacted other members of the committee. If bogus self-employment is an illegal practice then it is illegal. As to the question of whether that has been...

Chapter 8 - Measures relating to Cyber Security
Chapter 9 - Energy Efficiency National Fund
(6 Dec 2018)

David Cullinane: That is fair enough. I shall ask fairer questions. Did the Department seek a copy of that report or was the report given to the Department by RTÉ? Is there a relationship?

David Cullinane: I thank the witnesses for their replies.

Select Committee on Housing, Planning and Local Government: Local Government Bill 2018: Committee Stage (Resumed) (6 Dec 2018)

David Cullinane: I hope the Minister of State does not mean that.

Select Committee on Housing, Planning and Local Government: Local Government Bill 2018: Committee Stage (Resumed) (6 Dec 2018)

David Cullinane: I do not want to upset the committee's procedures but I have to get back to the Committee of Public Accounts. If it was possible for me to put the questions-----

Select Committee on Housing, Planning and Local Government: Local Government Bill 2018: Committee Stage (Resumed) (6 Dec 2018)

David Cullinane: I thank Deputy O'Brien and the Chair for her indulgence. We will all look at this through the lens of what is closest to us. I do not intend to get caught up in the hyperbole of this issue with regard to the commentary that will flow from this locally. It is obviously an issue that will be contentious in Waterford and Kilkenny. This boundary issue has been contentious for some time. I...

Pre-European Council Meeting: Statements (12 Dec 2018)

David Cullinane: Hear, hear.

Pre-European Council Meeting: Statements (12 Dec 2018)

David Cullinane: I would like if the Fianna Fáil leader when contributing in the Dáil on statements on the EU summit would not when speaking about the North attack Sinn Féin. It does not impress anybody. Many of the Fianna Fáil backbenchers have previously referenced Sinn Féin walking away from its responsibilities. We do not walk away from our responsibilities in the North. We...

Pre-European Council Meeting: Statements (12 Dec 2018)

David Cullinane: I did not interrupt speakers from the Fianna Fáil benches. Sinn Féin contests every election in the North and it has a mandate from the people. Fianna Fáil has no mandate in the North, nor does Fine Gael. They do not like elections in the North. They are the hurlers on the ditch.

Pre-European Council Meeting: Statements (12 Dec 2018)

David Cullinane: Neither party should criticise those who contest elections when they run away from voters in the North. Regardless of what happens today in Westminster, we have to make a number of observations about Brexit, the obvious one being that there is a withdrawal agreement on the table which provides basic protections for the North in the event of a no-deal Brexit. These include maintaining...

Local Government Bill 2018: Report and Final Stages (13 Dec 2018)

David Cullinane: The Deputy should not mention the war.

Local Government Bill 2018: Report and Final Stages (13 Dec 2018)

David Cullinane: There has been a lot of talk of power grabs, land grabs and hostile takeovers. Dick Turpin was also mentioned. I want to deal with matters that are much less contentious and much more civilised. Waterford-Kilkenny is one example of an area that would have been subject to the proposed urban area councils. I thank the Minister of State, Deputy Phelan, for his co-operation in working with...

Local Government Bill 2018: Report and Final Stages (13 Dec 2018)

David Cullinane: Hear, hear.

Public Accounts Committee: Business of Committee (13 Dec 2018)

David Cullinane: I do not agree with the premise of the letter and I support responding to it. I will make two points. Was an audit committee established within Áras an Uachtaráin as part of the changes that were made?

Public Accounts Committee: Business of Committee (13 Dec 2018)

David Cullinane: In future, when we are dealing with it, we can put questions to them as well. Has the audit committee met yet? It had not met when the Accounting Officer was before the committee.
