To follow up on a point made by Deputy Ó Laoghaire, Digital Rights Ireland last week said that the scheme as presented will inevitably end up in the courts and be appealed. Do the witnesses wish to reiterate that they feel the scheme as presented, if enacted, would not be permissible according to EU law?

Jack Chambers: If we create a two-tiered approach incorporating a strict necessity threshold, would the witnesses prefer, as Deputy Daly seems to wish, that everyone would have a high threshold regardless of their profession, background or potential category or do they feel there should be a separate threshold for journalists as proposed by Mr. Justice Murray? Which approach would the witness prefer to see?

Jack Chambers: In terms of the Bill and the current architecture around the District Court and the referee to the Circuit Court and the High Court providing a supervisory role, the Department last week said it would like there to be a pooled skill level at District Court level but Ms Farries feels that would be unworkable and would not give adequate protection to citizens.
