Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (29 Jun 2022)

David Stanton: To follow up on that, there is always a risk, even though it might be a slim one, of losing a court action. Ms McNamara said that if the State was underpinning this entity it would be open to major risks. I take that to mean financial risks. So far I can only see this applying to the CCPC. Are there other organisations that might apply to be qualified entities? Would they have the...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (29 Jun 2022)

David Stanton: Has any work been done on how high these costs might be? Is there a ballpark figure for a case like that?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (29 Jun 2022)

David Stanton: What is in this legislation to prevent abuse or opportunistic litigation? Is there anything there to dissuade people from going down that route?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Pre-legislative Scrutiny of the Companies (Protection of Employees' Rights in Liquidations) Bill 2021: Discussion (6 Jul 2022)

David Stanton: I welcome our guests and thank them for their contributions and for an interesting and important debate. Ms McElwee mentioned both in her submission and her presentation that there may be constitutional issues involved in making the changes that are suggested. Could she go into more detail on how she sees that working out?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Pre-legislative Scrutiny of the Companies (Protection of Employees' Rights in Liquidations) Bill 2021: Discussion (6 Jul 2022)

David Stanton: How does that impact on the Constitution or how does the Constitution impact on that, as Ms McElwee is suggesting?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Pre-legislative Scrutiny of the Companies (Protection of Employees' Rights in Liquidations) Bill 2021: Discussion (6 Jul 2022)

David Stanton: Ms McElwee might come back to us with some detail and find out exactly which section of the Constitution she is concerned about because I am not clear on that, but I hear what she is saying. I notice that the wage cap for calculating statutory redundancy has not changed for a long time. Would it make a difference if that were adjusted? Our friends from the trade unions or Ms McElwee...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Pre-legislative Scrutiny of the Companies (Protection of Employees' Rights in Liquidations) Bill 2021: Discussion (6 Jul 2022)

David Stanton: May I ask about the suggestion that has been made to set up a stand-alone fund to handle ex-gratiapayments in insolvency situations such as these? Will either side comment on that?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Pre-legislative Scrutiny of the Companies (Protection of Employees' Rights in Liquidations) Bill 2021: Discussion (6 Jul 2022)

David Stanton: A suggestion has been made that a stand-alone fund to handle ex-gratiapayments in insolvency situations be set up. Will the witnesses comment on that? What are their views on that? Would it be a good idea? How would it be done?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (29 Jun 2022)

David Stanton: According to the general scheme, a qualified entity has to have "12 months of actual public activity in the protection of consumer interests prior to its application for designation" and "a legitimate interest in protecting consumer interests", be "independent and not influenced by persons other than consumers" and be not-for-profit. What Deputy Bruton has been alluding to, and I am puzzled...

Joint Oireachtas Committee on Foreign Affairs and Trade, and Defence: Foreign Affairs Council and UN Security Council: Engagement with Minister for Foreign Affairs (12 Jul 2022)

David Stanton: Deputy Brady has asked a lot of the questions I wanted to ask. I congratulate the Minister and both Departments on the work they are doing. The presentation was short but the Minister packed a lot into it, not only on the amount of work but also on its quality and the impact Ireland is having in its role on the Security Council. I congratulate the Minister and his officials and our...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)

David Stanton: They are absolutely enormous figures - €1.5 billion is huge and 0.5% of GDP. I note it was proposed that Paris, Munich and London form the central division. Is there an opportunity for Ireland to take the place of London if we move quickly enough and have the central division in Ireland? What would it mean if that happened?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)

David Stanton: We need to pass legislation here. I notice that a general scheme was approved in 2014. Is there any indication of what has happened since then? It appears to have stalled, with no movement at all. Chairman, we need to send a strong message to the Department and the Minister that we must move on this as quickly as possible and have a referendum as soon as possible. That means we have to...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)

David Stanton: I certainly will be supporting moving as quickly as possible on this. From what I have read and having heard what the witnesses have said, it is crucial. I note there is a suggestion that the ratification date could be as far away as 2024. Is that too far out? Is it risky? Should we try to move before that, have a referendum and get this done?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)

David Stanton: I thank the witnesses for coming and for the presentation. They mentioned more than once that the ratification of this court would lead to substantial gains for the Irish economy. I have seen figures of 0.13% of GDP or even 0.5%, which is more than €1.5 billion. Will the witnesses give a breakdown of how those figures are arrived at and more detail on that?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)

David Stanton: Of course, because of our English-speaking population and common law jurisdiction - and I heard Mr. Gaffney's comment that we have to walk before we can run - further down the road we would be in a strong position to pitch for the central division. There is also the fact that we have many multinationals here. I thank the witnesses for their responses.
