David Stanton: 49. To ask the Minister for Rural and Community Development the level of support to be provided by her Department in 2021 for the development of remote working hubs; and if she will make a statement on the matter. [50048/21]
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: Yes, I will. I welcome the witnesses here today. This is an extremely complicated piece of legislation that contains a significant amount of detail. From the reaction I have read of most of the people who have made submissions, it appears to be welcome and needed. The statutory rights of consumers are to be enhanced and more power is to be given to the regulator. I wish to ask about...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: The proposal on the sale of live animals is also interesting. Will the officials expand on that, please? It is article 3.5 (b) which enables living animals to be excluded from the scope. The Department is not implementing that.
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: Very often consumers purchase equipment and they install it themselves and it goes wrong because the instructions are not clear. There is an issue here with respect to who is liable. Will the officials explain what the legislation is doing in that regard, please?
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: Is there something in there that states the installation of goods should be carried out by a qualified person? In other words, if I as a consumer try to install something and I make a mess of it resulting in damage to the equipment, material or whatever I am doing, where does the liability lie then?
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: Okay. Will Ms Hanrahan speak about the limit of liability of a trader? There was a suggestion at some stage that it should be shortened.
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: Ms Hanrahan mentioned cars. Will she speak on the trade-in value of cars, something which is quite current? That is head 28(5)(b). The Law Society submission argued that "in order to avoid difficulties with Head 28(5)(b) where a trade-in value was not ascribed,a trader should be to specify a monetary value for all trade-in goods, particularly in car sales and part exchanges".
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: What I am getting at is where consumers are cajoled into purchasing extra warranty. Is that a waste of money? Is it something that is not really required as they are already protected under the legislation? Do they need to do this or is it a money-making racket?
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: The legislation, as an earlier Deputy said, is extremely complex. It is quite important that it be available to consumers in an easy to understand format when it is finally enacted because it is really long, complex and difficult
- Select Committee on Foreign Affairs and Trade, and Defence: Partnership and Cooperation Agreement Between the European Union and the Republic of Singapore: Motion (13 Oct 2021)
David Stanton: I welcome the Minister of State on his first visit to the committee and I thank him for being here and for his introduction. I want to raise a few issues on human rights in Singapore and whether they are taken into account when drawing up agreements such as this. I understand there is an internal security Act and they have issues with the suppression of media, freedom of expression and...
- Select Committee on Foreign Affairs and Trade, and Defence: Partnership and Cooperation Agreement Between the European Union and the Republic of Singapore: Motion (13 Oct 2021)
David Stanton: I thank the Minister of State for his response and wish him well in his work. There are reports about the treatment of migrants in Singapore. As we enter a trade agreement with Singapore, where employment is important, I draw the attention of the Minister of State to the conditions experienced by migrants in Singapore. It is not a positive situation. I ask him to add the matter to his...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Consumer Rights Bill 2021: Discussion (13 Oct 2021)
David Stanton: Finally, I refer to guarantees. When a consumer purchases a piece of equipment, say a television, microwave or fridge, often the shop will suggest that they might like to purchase additional warranty. What is the legality on that and its value? Is there anything to be gained by that because there is already a lot of built-in protections in the legislation if something goes wrong?
- Ceisteanna ar Reachtaíocht a Gealladh - Questions on Promised Legislation (20 Oct 2021)
David Stanton: We have all heard the toxic discussions and debates with respect to politicians, the hate speech and so on. Councillors are resigning or retiring early, before their time. The programme for Government states that the Government will "Consider the introduction of an alternate/substitute candidate list to cover parental and caring leave, long-term illness leave, resignation [and so on, and]...
- Written Answers — Department of Communications, Climate Action and Environment: Solar Energy Guidelines (20 Oct 2021)
David Stanton: 66. To ask the Minister for Communications, Climate Action and Environment the funding available for the solar electricity grant in 2021; and if he will make a statement on the matter. [51335/21]
- Ceisteanna Eile - Other Questions: Domestic Violence (21 Oct 2021)
David Stanton: I commend the Minister and the Department on the supports they are providing in this area, but I put it to her that it is quite often the case that when court cases occur, which is often a long time after the events in question, the victims are retraumatised and there is further need at that stage for support and counselling. I ask the Minister to take that request on board and revert to me...
- Ceisteanna Eile - Other Questions: Citizenship Applications (21 Oct 2021)
David Stanton: A number of these citizenship applications are probably from members of the Defence Forces who are foreign nationals. Would the Minister of State and the Department examine the possibility of reducing the fees in cases like that because these people are serving the State?
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Resourcing and Capacity of the Workplace Relations Commission: Discussion (20 Oct 2021)
David Stanton: I might come in again later but I will be very brief. I am from an area where there are a number of fishermen and I am concerned about the general impression that might be given about the industry generally, for example, that abuse is widespread. I ask Mr. Kelly and Mr. O'Brien to comment on that. I am worried about the owners of boats and people who are doing their best to comply, who are...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Resourcing and Capacity of the Workplace Relations Commission: Discussion (20 Oct 2021)
David Stanton: I thank the Chairman. I join with Deputy O’Reilly where she pointed out that there are employers who are trying to do the right thing and we have to be careful that we do not give the impression that every employer is breaking the law. I take what Mr. Kelly said earlier on that there are some contraventions that are administrative and so forth but there are also some that are very...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Resourcing and Capacity of the Workplace Relations Commission: Discussion (20 Oct 2021)
David Stanton: Apart from the fishers’ sector, has Mr Kelly encountered trafficking in other areas of employment in his work?
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Resourcing and Capacity of the Workplace Relations Commission: Discussion (20 Oct 2021)
David Stanton: I thank Mr. Kelly. I will return to Mr. O’Brien with other questions in respect of citizenship. We know that after five years on the atypical scheme, workers can apply for citizenship. Is he aware whether this is known or whether many people have done that?
