Public Accounts Committee: Business of Committee (3 May 2018)

Catherine Murphy: We discussed this matter last week in the context of the HSE and open disclosure and we decided we would have both the HSE and the State Claims Agency before the committee to try to make some sense of why we are not seeing open disclosure to the extent that we would expect to see it. I think every one of us will reiterate the point that there is not only a human cost to this, but also a loss...

Public Accounts Committee: Business of Committee (3 May 2018)

Catherine Murphy: Then we got the document from the HSE, which told us the current position and how this flowed out of a study that was done on patient care and safety. That document told us that 20,000 of the HSE's staff were trained in this. The Health Service Executive has about 130,000 staff, and it is not that every one of them would need to be trained in this. Is that the extent of the training?...

Public Accounts Committee: Business of Committee (3 May 2018)

Catherine Murphy: Was the document from the State Claims Agency published?

Public Accounts Committee: Business of Committee (3 May 2018)

Catherine Murphy: We have a job of work to do anyway, which we decided.

Public Accounts Committee: Business of Committee (3 May 2018)

Catherine Murphy: It is wider than the cervical screening issue, which is evolving. Therefore, it should be on our work programme, and it should be around open disclosure, system failures and whether we are getting value for money when so much money is being spent on legal fees, which may be the difference in being able to provide services.

Public Accounts Committee: Business of Committee (3 May 2018)

Catherine Murphy: What is on our programme for next week?

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: Ms Forbes announced a review of employment practices in RTÉ some time ago and the firm Eversheds was employed to do that review. It was due to be delivered in March. Where is it at this stage? Will it go before the executive board? Could Ms Forbes briefly give us an outline of the terms of reference?

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: Just very briefly.

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: As we have heard, RTÉ employs a significant number of workers across the organisation on contracts for service. RTÉ insists that they register as self-employed. Did I hear that correctly? They are not on a temporary contract. They are registered as self-employed on RTÉ's insistence. Is that the case?

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: In terms of the status of employment for work.

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: So they are not temporary employees, they are contractors, self-employed, whatever.

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: What range of skills does that go across? Is it right across the spectrum or confined to particular aspects of the work?

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: Earn your keep.

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: Some of those, as we have heard, would be of short duration. Some of them would be almost permanently deployed in and around Montrose or for RTÉ. Would that be the case?

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: For example, if somebody who was working constantly, and it was their main employment, was deemed to be self-employed, could they contest their employment status? Could they seek to be an employee? Is that available to them at this stage and has it happened?

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: Through their working life, people can end up with a difficulty of some sort. An employee has recourse to the Workplace Relations Commission. A self-employed person would not have this recourse. Is that something RTÉ is looking at in the context of that review?

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: I presume it will go in front of the executive board and that is where the discussion will happen first.

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: Is it likely to be made public? At what point will that happen? Would it be after discussions? I am presuming there will be a process to be gone through.

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: I presume some of the more high-profile people who would be self-employed would have agents.

Public Accounts Committee: Vote 29 - Department of Communications, Climate Action and Environment (3 May 2018)

Catherine Murphy: Is there a variation? Has there been an analysis suggesting that somebody who has an agent does better than somebody who has not? Is there anything that gives a preferential advantage by virtue of the fact that they have an agent as opposed to somebody who is a direct employee?
