- Public Service Pensions (Single Scheme) and Remuneration Bill: Second Stage (19 Oct 2011)
Seán Fleming: When we raised the matter with the Minister by way of a parliamentary question, the longest paragraph in the reply stated: "I should point out that, before the end of this month, I will introduce the Public Service Pensions (Single Scheme) and Remuneration Bill 2011." The Minister spelt it out. The Minister tries to give the impression when we talk about obscene payments for new Secretaries...
- Public Service Pensions (Single Scheme) and Remuneration Bill: Second Stage (19 Oct 2011)
Seán Fleming: It is extra information but I am simply dissecting it so that people will not take the view that the issues are directly related. The Minister should move on the matter sooner or later. I understand the Minister wishes to exclude certain commercial bodies. The Schedule to the Bill refers to bodies to which the definition of "public service bodies" does not apply. These include any body...
- Public Service Pensions (Single Scheme) and Remuneration Bill: Second Stage (19 Oct 2011)
Seán Fleming: A Secretary General might get the job and decide to retire, taking that extra seven years. Or, because the arrangements of a Secretary General may be slightly different, we could consider a position close to that grade. As drafted, there is a tremendous incentive for a person who arrives at a high rate to leave on sick leave because he or she will get the extra seven years at the maximum...
- Debt Settlement and Mortgage Resolution Office Bill 2011: Second Stage (Resumed) (19 Oct 2011)
Seán Fleming: I welcome the opportunity to speak on the Debt Settlement and Mortgage Resolution Office Bill 2011. To give more acknowledgement to what is involved in the legislation I will mention the full title, which is a "Bill entitled an Act to reform the law on personal insolvency; to provide for a non-judicial debt settlement arrangement process concerning personal debt; to provide for a...
- Debt Settlement and Mortgage Resolution Office Bill 2011: Second Stage (Resumed) (19 Oct 2011)
Seán Fleming: I use the term "maxed out" because people are familiar with it from credit card use. I compliment Deputy Michael McGrath on his outstanding work. It is good that the Opposition is being constructive. It is very easy for an Opposition party to come to the House and oppose for the sake of it. We want to provide more credible and sustainable opposition in order that people will see that...
- Debt Settlement and Mortgage Resolution Office Bill 2011: Referral to Select Committee (19 Oct 2011)
Seán Fleming: I move: That the Bill be referred to the Select Committee on Justice, Defence and Equality, in accordance with Standing Order 82A(3)(a) of the Orders of Reference of that committee.

- Report by the Interdepartmental Working Group on Mortgage Arrears: Statements (Resumed) (20 Oct 2011)
Seán Fleming: I welcome the opportunity to speak in the debate on the report of the interdepartmental working group on mortgage arrears. I welcome the report as an input to the general debate. It is in no way a definitive report. It is not intended to be such and it was not set up with that purpose. It was set up with narrow terms of reference to deal with specific issues. I never saw such specific...
- Report by the Interdepartmental Working Group on Mortgage Arrears: Statements (Resumed) (20 Oct 2011)
Seán Fleming: I thank the Minister for being present and responding to the questions. I acknowledge that the Government has agreed to accept the Second Reading of the Private Member's Bill yesterday. The public would like to see the House working collectively rather than points-scoring in a partisan fashion. Does the Minister not accept that one cannot just deal with mortgage debt on its own? Anyone...
- Report by the Interdepartmental Working Group on Mortgage Arrears: Statements (Resumed) (20 Oct 2011)
Seán Fleming: It is a fact. I have seen it in my constituency. I asked how people got their mortgage. People took out a 35 year mortgage on a wedding but some of the marriages might not have lasted 35 months.
- Report by the Interdepartmental Working Group on Mortgage Arrears: Statements (Resumed) (20 Oct 2011)
Seán Fleming: That happened. I want people to know. People got credit cards and other bills added together. The situation is that clearly there was irresponsible lending by the banks. I am only talking on a case-by-case basis. I know one cannot generalise. I refer to cases where banks gave out loans they should not have given out based on projected incomes that were never going to materialise. They...
- Report by the Interdepartmental Working Group on Mortgage Arrears: Statements (Resumed) (20 Oct 2011)
Seán Fleming: In those cases the banks should be made to pay a heavier contribution to resolving the problem because the loans are unsustainable. I do not blame the young 20 year olds who out such loans. When one is dealing with a big financial institution that is in business for donkey's years, one expects it to know that end of the business. The banks in those cases should pay a heavier contribution...
- Report by the Interdepartmental Working Group on Mortgage Arrears: Statements (Resumed) (20 Oct 2011)
Seán Fleming: I asked about intermediaries between banks and borrowers.
