- Seanad: Thirty-First Amendment of the Constitution (Children) Bill 2012: Second Stage (2 Oct 2012)
Trevor Ó Clochartaigh: Tá céad fáilte roimh an Aire. TréaslaÃm léi ó chroà as ucht an reachtaÃocht seo a thabhairt os ár gcomhair. Is lá iontach stairiúil é don tSeanad agus lá tábhachtach do pháistà na tÃre. Cuireann Sinn Féin fáilte roimh an mBille agus roimh an reifreann a bhéas á reachtáil i Mà na Samhna. Ró-fhada atá sé nach raibh cearta na leanaà á gclúdach ins an mBunreacht....
- Seanad: Thirty-First Amendment of the Constitution (Children) Bill 2012: Second Stage (2 Oct 2012)
Trevor Ó Clochartaigh: We will have no more of that, lads, if you do not mind. It is important there is cross-party support.
- Seanad: Thirty-First Amendment of the Constitution (Children) Bill 2012: Second Stage (2 Oct 2012)
Trevor Ó Clochartaigh: I doubt it. Not unless things change radically. There is an issue about the coverage of the referendum. There are rumours that the 50:50 rule regarding coverage of this referendum might be challenged. That would be a very dangerous step to take, for a number of reasons. First, that could become the issue, as opposed to the actual referendum and passing it. Second, if there are people...
- Seanad: Thirty-First Amendment of the Constitution (Children) Bill 2012: Committee Stage (3 Oct 2012)
Trevor Ó Clochartaigh: I do not have the legal background of some of my esteemed colleagues but I raised the issue yesterday of children in direct provision. The section asks whether the parents have failed in their duty towards children. There are quite a number of children in direct provision who do not have their parents with them and are left to their own means within the system. Will the Minister clarify...

I move amendment No. 4: In Part 1, page 6, line 23, to delete ?a thabharfaidh an Stát? and substitute ?ar páirtà iontu...
- Seanad: Thirty-First Amendment of the Constitution (Children) Bill 2012: Committee Stage (Resumed) and Remaining Stages (3 Oct 2012)
Trevor Ó Clochartaigh: I thank the Minister for her comprehensive answer and appreciate what she said. However, this issue will be a very important part of the debate around the referendum in that this provision could be read as stating the State is being precluded in a sense from taking into account the best interests of the child and therefore if cases are taken against the State in the future the State's best...
- Seanad: Thirty-First Amendment of the Constitution (Children) Bill 2012: Committee Stage (Resumed) and Remaining Stages (3 Oct 2012)
Trevor Ó Clochartaigh: Tairgim leasú a 5: I gCuid 1, leathanach 7, lÃne 27, ?nó aon ábhar breithiúnach eile maidir le haon leanbh? a chur isteach i ndiaidh ?rochtain ar aon leanbh?, agus I gCuid 2, leathanach 9, lÃne 27, ?or any other judicial matter concerning,? a chur isteach i ndiaidh ?access to,?.I move amendment No. 5:In Part 1, page 6, line 27, after "rochtain ar aon leanbh" to insert "nó aon ábhar...
- Seanad: Thirty-First Amendment of the Constitution (Children) Bill 2012: Committee Stage (Resumed) and Remaining Stages (3 Oct 2012)
Trevor Ó Clochartaigh: Ba mhaith liom tréaslú leis an Aire as ucht an reachtaÃocht seo a thabhairt trÃd na Tithe. Is lá stairiúil é seo. Is lá an-tábhachtach é do leanaà na tÃre. Tá áthas orm go bhfuilimid in ann tacú leis an Aire san obair seo. Ba mhaith liom tréaslú freisin le comhghleacaithe an Aire sa Roinn, mo chomh-Sheanadóirà agus Teachtaà Dála agus na daoine ar fad a d'oibrigh ar...
- Seanad: Order of Business (4 Oct 2012)
Trevor Ó Clochartaigh: Táim chun ceist a ardú ar chúrsaà sláinte. Is mór an náire à an gheamaireacht atá ar bun faoi láthair agus tá sà ag baint aird ar fad de na prÃomh cheisteanna sláinte atá sa tÃr go gcaithfear a dhÃriú orthu. The pantomime in which Deputy James Reilly is the main protagonist would be funny if it was not so serious. It is taking the focus away from the serious health issues...

Trevor Ó Clochartaigh: On a point of order-----
- Seanad: Order of Business (4 Oct 2012)
Trevor Ó Clochartaigh: It is a point of order. Calls were made on the Order of Business for a motion of no confidence in the Minister for Health. The Leader indicated that we would have an opportunity to raise particular concerns when the Minister came to the House for a debate on a particular item of legislation. Will it be possible to table a motion of no confidence during that debate or as an amendment to the...
- Seanad: Ombudsman (Amendment) Bill 2008: Committee Stage (4 Oct 2012)
Trevor Ó Clochartaigh: Cuirim fáilte roimh an Aire arÃs. Táim ag súil go mór leis an dÃospóireacht inniu mar tá an Bille seo thar a bheith tábhachtach. Tagaim leis an méid atá á rá ag an Seanadóir Barrett. An léamh a d'fhéadfá a bhaint as an leasú áirithe seo ná go bhfuil muid ag tabhairt sé mhà breise do na heagraÃochtaà eile seo an seó atá acu a ghlanadh suas, rud nach bhfuil agus...

Trevor Ó Clochartaigh: No.
- Seanad: Ombudsman (Amendment) Bill 2008: Committee Stage (4 Oct 2012)
Trevor Ó Clochartaigh: It is a matter for the House to decide how the legislation is to be taken.
- Seanad: Ombudsman (Amendment) Bill 2008: Committee Stage (4 Oct 2012)
Trevor Ó Clochartaigh: While I appreciate the comments of the Minister, I am in general agreement with Senator Sean D. Barrett. On a number of occasions I have experienced groups of amendments being rushed. I would much prefer if the amendments were not grouped. The Chair should use his abilities judiciously to ensure Senators do not repeat themselves when speaking on different amendments.
- Seanad: Ombudsman (Amendment) Bill 2008: Committee Stage (4 Oct 2012)
Trevor Ó Clochartaigh: It is one the Acting Chairman is able to meet.
- Seanad: Ombudsman (Amendment) Bill 2008: Committee Stage (4 Oct 2012)
Trevor Ó Clochartaigh: No.
- Seanad: Ombudsman (Amendment) Bill 2008: Committee Stage (4 Oct 2012)
Trevor Ó Clochartaigh: On a point of order, are the amendments being discussed as a group or individually? The substantive amendments are amendments Nos. 20 and 33 to 35, inclusive.
- Seanad: Ombudsman (Amendment) Bill 2008: Committee Stage (4 Oct 2012)
Trevor Ó Clochartaigh: Yes, but as Senator Sean D. Barrett said, they cover many areas. I would not have an issue if we were to have smaller groupings, say, one group up to amendment No. 18, with amendments Nos. 20, 33 to 35, inclusive, as a separate grouping.
