What might the reason be and in what form might the publication take? Deputy O'Callaghan gave an example of the appointment of his colleague, Deputy Jack Chambers, but what kind of reason would he see as being appropriate...

Charles Flanagan: I see the line being crossed in terms of the unfettered constitutional prerogative on the part of Government in the appointment of judges. Asking the Government to justify actions taken on foot of the exercise of such a provision is, to my mind, legally problematic.
