- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: Amendment No. 24 would allow people to have advance notice so that they could make humanitarian representations. I ask the Minister to comment on that.
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: While I do not have a problem with the section or the amendment in general, I ask the Minister to accept the amendment to amendment No. 23, the purpose of which is to ensure the guidelines issued by the chairperson of the tribunal would be made public and that the Houses of the Oireachtas could address any problems which may arise.
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: I move amendment No. 25: In page 7, before section 6, to insert the following new section: 6.âThe Illegal Immigrants (Trafficking) Act, 2000 is amended: (a) in section 5(2)(a) by the deletion of '14' and the substitution of '35', (b) in section 5(3)(a) by the insertion after the third and fourth references to 'the High Court' of 'or the Supreme Court'.". The amendment proposes to...
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: If amendments were accepted they would give rise to constitutional challenges. Article 26 is a good procedure but, on the other hand, it is good for people to be able to test the constitutionality of legislation by applying it to real facts and events. Will the Minister consider the issue of providing for leave to appeal to the Supreme Court?
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: Despite the Minister's comments, I am still not clear as to the purpose or meaning of this amendment. I reserve my position on it. I am not in support of it. Amendment put and declared carried. Sections 6 and 7 agreed to. NEW SECTION.
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: I move amendment No. 27: In page 7, before section 8, to insert the following new section: 8.âA restatement of the enactments relating to non-nationals, immigration and asylum as amended inter alia by this Act shall be prepared under the Statute Law (Restatement) Act, 2002, as soon as may be after the passing of this Act.". The law on immigration and asylum goes back to 1935 and has been...
- Seanad: Order of Business. (4 Feb 2003)
Joanna Tuffy: Will the Leader ask for a debate with the Tánaiste to find out what the Government is doing to ensure we have a competitive workforce? There is no point in just being shocked or disappointed at factory closures. We need investment in skills, education, training and research and development but the opposite is happening through cutbacks in third level education and research and development....
- Seanad: Immigration Bill 2002: Report Stage. (4 Feb 2003)
Joanna Tuffy: I second the amendment.
- Seanad: Immigration Bill 2002: Report Stage. (4 Feb 2003)
Joanna Tuffy: I move amendment No. 2: In page 4, line 25, after "officers" to insert "if required to do so by such directions (if any)". The reason we propose the insertion of the words "if required to do so by such directions (if any)" is that we believe the drafting of this section is defective and we intend to achieve clarity with our amendment. It is intended to make clear that total disembarkation...
- Seanad: Immigration Bill 2002: Report Stage. (4 Feb 2003)
Joanna Tuffy: I move amendment No. 3: In page 4, after line 46, to insert the following: "(4) This section shall not apply to an alleged contravention by a person who arrives in the State having a well-founded fear of persecution in his or her country of nationality, or (in the case of a Stateless person) habitual residence.". The Bill should not be a measure which will prevent people entitled to asylum...
- Seanad: Immigration Bill 2002: Report Stage. (4 Feb 2003)
Joanna Tuffy: It is being withdrawn but I would like the Minister to reconsider the matter. Amendment, by leave, withdrawn.
- Seanad: Immigration Bill 2002: Report Stage. (4 Feb 2003)
Joanna Tuffy: I second these amendments. The Minister should be obliged to publish guidelines because the Bill places a substantial obligation on carriers to which it will be difficult for them to adjust. It is important to state clearly what they will have to do. In addition, the guidelines should be reviewed regularly.

- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)

- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)
Joanna Tuffy: I move amendment No. 8: In page 8, line 33, to delete "5" and substitute "25". My party has brought forward this amendment in an attempt to change the period of time allowed for the submission of a contact address from five working days to 25. It is likely that immigrants would be unable to secure such an address within five days despite administrative procedures aimed at ensuring they do....
- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)
Joanna Tuffy: I move amendment No. 10: In page 9, line 28, to delete "3" and substitute "21". This section of the Bill gives persons who do not show up for a meeting with the commissioner three working days to explain the reasons for their non-attendance. If the amendment is accepted, however, such people will have 21 working days to provide an explanation. I wish to change the rule under which a person...
- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)
Joanna Tuffy: I move amendment No. 11: In page 9, line 39, after "declaration" to insert "to such an extent as to warrant the application of this subsection". The purpose of this amendment is to ensure that only significant breaches of the duty to co-operate will result in the application being deemed withdrawn. I recognise what the Minister says about the need to ensure the asylum-seeking provisions are...
- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)
Joanna Tuffy: I welcome the fact that the Minister has increased the time limit to 15 days, but it should have been extended further. Amendment agreed to. Amendment No. 15 not moved.
- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)
Joanna Tuffy: I move amendment No. 16: In page 10, line 16, to delete "no" and substitute "in the case of an appeal withdrawn under section 9, no". As I have already said to the Minister, the provision for failure to co-operate is very serious. While we accept that there should not be a provision for someone to appeal the withdrawal of his own application, there could be circumstances in which somebody...
