- Other Questions: Legal Matters (25 Nov 2015)
Michael Fitzmaurice: I ask the Minister for Agriculture, Food and the Marine if a formal investigation was conducted into the farm investment scheme and the farm waste management schemes and the reason a landowner, whose details are supplied, was not notified of a formal investigation or the outcomes. Will the Minister make a statement on the matter?
- Other Questions: Legal Matters (25 Nov 2015)
Michael Fitzmaurice: I am not asking the Minister to get into legal jargon. All I am asking is whether a formal investigation concluded, if the person was informed and, if not, why did that not happen at the beginning. I am not trying to back the Minister into a corner and telling him to be judge and jury. All I am looking for is a straight answer.
- Other Questions: Legal Matters (25 Nov 2015)
Michael Fitzmaurice: That is fair enough and I understand where the Minister is coming from. In fairness to a lot of these people to whom I have spoken in great detail, they have tried to look at every angle. Some of it was before the Minister's time and I do not lay the blame entirely at his door. There are always windows of opportunity to resolve problems, but if doors are locked and the hatches are battened...
- Motor Vehicles (Duties and Licences) Bill 2015: Second and Subsequent Stages (25 Nov 2015)
Michael Fitzmaurice: I commend the Minister on reducing motor tax on heavy goods vehicles. As someone who has been involved with haulage over the years, I have been advocating this change for some time. The current levels of motor tax were crippling for Irish hauliers, especially those involved in trade to the Continent. As the Minister will be aware, trucks must pay £10 per day for using the roads in...
- Motor Vehicles (Duties and Licences) Bill 2015: Second and Subsequent Stages (25 Nov 2015)
Michael Fitzmaurice: I understand that one cannot win all the time. The issue has caused some confusion, although to be fair to the Minister he has provided clarity on the matter in recent days. I ask the Minister and the Minister for Transport, Tourism and Sport, Deputy Pascal Donohoe, to examine another issue which came to my attention this evening. Under a new tachograph system for tractors being...

Michael Fitzmaurice: What about permits?
- Criminal Justice (Burglary of Dwellings) Bill 2015: Second Stage (Resumed) (25 Nov 2015)
Michael Fitzmaurice: I welcome the opportunity to speak on this Bill. There are many parts to it that I welcome. There is no doubt but that reoffenders have been getting away time and again. I welcome the moves to curtail this. I advocate the tightening up of the legal aid system in respect of people who reoffend two or three times. The system cannot continue dealing with reoffenders. I listened to an...
- Written Answers — Department of Agriculture, Food and the Marine: Commonage Land (25 Nov 2015)
Michael Fitzmaurice: 12. To ask the Minister for Agriculture, Food and the Marine in relation to the Roxborough and Derrybrien West commonage lands, the reason he did not apply his Department's inspection findings from the inspections undertaken in or around October 2013, the findings of which he sought to apply without notice or right of appeal to the shareholders in October 2014; and if he will make a statement...

Michael Fitzmaurice: 16. To ask the Minister for Agriculture, Food and the Marine if he is satisfied that the review which he authorised following the European petitions committee’s recommendation to conduct a fresh and independent inspection into the Keelderry commonage lands was sufficiently fresh and independent; and if he will make a statement on the matter. [41240/15]
- Written Answers — Department of Agriculture, Food and the Marine: Commonage Land (25 Nov 2015)
Michael Fitzmaurice: 31. To ask the Minister for Agriculture, Food and the Marine why he has not accepted the evidence that the shareholders of the Keelderry commonage lands have provided, in the form of a detailed survey and report by suitably qualified experts, with their applications under the 2015 basic payment scheme; and if he will make a statement on the matter. - Written Answers — Department of Agriculture, Food and the Marine: Land Parcel Identification System (25 Nov 2015)
Michael Fitzmaurice: 94. To ask the Minister for Agriculture, Food and the Marine if he is aware that the inspection criteria and his inspectors’ interpretation, methodology and procedures cannot be relied upon, as stated recently by the appeals office in his Department, as the exclusions provide no quantification or description for the deductions made in relation to an applicant (details supplied) in...
- Joint Oireachtas Committee on Transport and Communications: Conviction Rates for Drink Driving: Discussion (25 Nov 2015)
Michael Fitzmaurice: I apologise for not being present earlier but I was attending Question Time in the Dáil. I wish to raise the requirement for a driver to carry his driving licence when driving a vehicle. This is a problem I have had myself, as have others like me. A person may jump into a van and leave their licence in the van, forgetting to take it if they go on to a machine or a tractor.
- Joint Oireachtas Committee on Transport and Communications: Conviction Rates for Drink Driving: Discussion (25 Nov 2015)
Michael Fitzmaurice: Could a measure be brought in so that a person could have a clear copy of their licence in each vehicle if need be? The driver certificate of professional competence is held over a five-year period and people are supposed to do one a year. Some people do not get to one a year and they could do two the next year, but they have to write in letters and give excuses as to why they could not...
- Joint Oireachtas Committee on Transport and Communications: Conviction Rates for Drink Driving: Discussion (25 Nov 2015)
Michael Fitzmaurice: Yes, graduated fines. After the third time there could be a slap on the wrist and the penalty points could be applied, but before that it should be a monetary type of penalty. I will conclude on that note. I thank Mr. Naughton for what was done in Athlone. It was very efficient.
- Joint Oireachtas Committee on Transport and Communications: Conviction Rates for Drink Driving: Discussion (25 Nov 2015)
Michael Fitzmaurice: I forgot to make this point. If a person is driving with a wagon in England, if the Vehicle and Operator Services Agency, VOSA, goes through their vehicle and sees a crack in a leaf spring the driver will be given a piece of paper saying that it has to be repaired in 14 days. In Ireland, it is a low loader. We have to think of businesses as well. We must engage common sense in what we...

- Joint Oireachtas Committee on Transport and Communications: Conviction Rates for Drink Driving: Discussion (25 Nov 2015)
Michael Fitzmaurice: I am directing my question about the licences for those who had to go through the theory test to the RSA. There are problems, and they are not getting the licences.
- Written Answers — Department of Arts, Heritage and the Gaeltacht: Deer Hunting (26 Nov 2015)
Michael Fitzmaurice: 227. To ask the Minister for Arts, Heritage and the Gaeltacht the number of gun day licences that were given out to a gun club (details supplied) in County Sligo in the 2014 to 2015 season by An Garda Síochána, for deer hunter day licence, and for bird hunter day licence; and if she will make a statement on the matter.
