Seanad: Road Traffic Bill 2011: Committee Stage (19 Jan 2011)

Paschal Donohoe: Any one of the four. Is the Minister of State satisfied that the wording of the Bill makes it clear that a person is required to meet only one of those four criteria? That is a question for her to consider before the Bill moves forward. I have seen it laid out in other legislation that a person is required to meet only one of the criteria set out. If the Government is satisfied with the...

Seanad: Road Traffic Bill 2011: Committee Stage (19 Jan 2011)

Paschal Donohoe: When we did the original Bill, we were told that every section would be challenged in the future because of the regularity of challenges to such legislation in the courts. These are not just points of grammar. We want to ensure the Bill is as robust as possible. Senator Quinn has picked up on an important point, namely, the presence of the word "or" in paragraph (c). If "or" is required...

Seanad: Road Traffic Bill 2011: Committee Stage (19 Jan 2011)

Paschal Donohoe: With respect, there is a difference between going into a restaurant and ordering a cup of tea and putting together legislation that will be challenged. This is an eminently fair point and the Minister of State's response that she is satisfied is not good enough. The question still stands. If "or" is present in paragraph (c), why is it not present in paragraphs (a) or (b)?

Seanad: Road Traffic Bill 2011: Committee Stage (19 Jan 2011)

Paschal Donohoe: The Attorney General would of course be satisfied with any legislation that comes into the House but that does not mean he is right. It is incumbent on us that if we feel the legislation can be improved, we will try to do it. I join Senator Quinn in tabling an amendment on Report Stage.

Seanad: Road Traffic Bill 2011: Committee Stage (19 Jan 2011)

Paschal Donohoe: I wish to table an amendment on Report Stage that I am currently drafting.

Seanad: Road Traffic Bill 2011: Committee Stage (19 Jan 2011)

Paschal Donohoe: Given that the Minister for Transport is back, could we retrace our steps?

Seanad: Road Traffic Bill 2011: Report Stage (19 Jan 2011)

Paschal Donohoe: I second the amendment. I welcome the Minister back to the House and thank Senator Quinn for his proposal regarding the point we raised on Committee Stage. The House had time to examine the Road Traffic Bill 2009 during the adjournment, in particular, the definition applied to the number of events in which a garda should become involved and the format of section 8. At one stage it read: is...

Seanad: Road Traffic Bill 2011: Report Stage (Resumed) and Final Stage (19 Jan 2011)

Paschal Donohoe: I second the amendment.

Seanad: Road Traffic Bill 2011: Report Stage (Resumed) and Final Stage (19 Jan 2011)

Paschal Donohoe: I second the amendment.

Seanad: Road Traffic Bill 2011: Report Stage (Resumed) and Final Stage (19 Jan 2011)

Paschal Donohoe: I agree with Senator Quinn. On the many pieces of transport legislation taken in the House in recent years I have always appreciated the constructive attitude adopted by the Minister to amendments tabled by Members on this side of the House. At different stages he has accepted amendments tabled by Senator Ryan and me or Independent Senators such as Senators Quinn and Norris. We have...

Seanad: Schools Building Projects (20 Jan 2011)

Paschal Donohoe: I thank the Minister of State for his attendance. The issue I raise is the status of Gaelscoil Bharra in my constituency. I have raised this matter on several occasions in the House. A building project for the school has progressed in recent years and I understand the Department of Education and Skills is involved in discussions with staff and parents regarding the potential design of the...

Seanad: National Monument at 14-16 Moore Street, Dublin: Statements (26 Jan 2011)

Paschal Donohoe: I thank the Minister of State for his detailed contribution and extend a welcome to the relatives of the signatories who are present to listen to the debate. It is an important debate at this time, given the events that have taken place in the country in recent months. There has been a great deal of discussion in this House of the role and nature of our economic independence and sovereignty...

Seanad: Finance Bill 2011: Second Stage (28 Jan 2011)

Paschal Donohoe: I wish to concentrate on the future of our economy, which is what the Finance Bill is all about. Whatever points people have to make about the future of our economy and how it will recover, they must recognise an essential fact, namely, that politicians do not create 80% of the jobs created in this country. They do not directly create the jobs within the private sector that will be vital to...

Seanad: Finance Bill 2011: Second Stage (28 Jan 2011)

Paschal Donohoe: The anger that permeates our country currently will either be replaced by complete despair or by weariness. Both of these forces are in their own way as dangerous and volatile as what we face at the moment. It is fundamentally important for the next government to ensure a period of stability within which businesses, individuals and families can make choices. They must know the horizon and...

Seanad: Finance Bill 2011: Second Stage (28 Jan 2011)

Paschal Donohoe: We have to reclaim the centre; the centre must hold. I have been privileged to be a Member of this Seanad for the past three years. Regardless of what happens to me in the general election, I will not address or speak in the next Seanad. I will conclude with a plea for the politics of the centre to hold. Just because one has a moderate opinion does not mean one should articulate that...

Seanad: Finance Bill 2011: Second Stage (28 Jan 2011)

Paschal Donohoe: No.

Programme for Government: Motion (15 Mar 2011)

Paschal Donohoe: I thank the people of Dublin Central for their support and I look forward to working with all my colleagues to benefit the country and the constituency. As I stand in front of the Dáil I wonder what people had in mind when they went to vote for us. There were two things they wanted to achieve - diversity and stability - and by casting their votes they have achieved both. They have a...

Corporation Tax: Motion (Resumed) (23 Mar 2011)

Paschal Donohoe: With the agreement of the House, I will share time with Deputies Robert Dowds, Terence Flanagan, Colm Keaveney and Aodhán Ó Ríordáin. Today in the run-up to this weekend's EU summit, the German Chancellor, Angela Merkel, made a statement of her Government's stance on these negotiations, which is shared by some of the larger member states. She said, "We are still in talks with Ireland and...

Universal Service Charge: Motion (29 Mar 2011)

Paschal Donohoe: I second the Government's amendment to the motion. I would like to begin by acknowledging that nobody wants to pay tax. In particular, nobody wants to pay higher rates of tax. We do not want to find ourselves in a situation where we are asking people to pay more tax at a time when they have less money. If we look at what our economy has gone through, there are two points that are...

Universal Service Charge: Motion (29 Mar 2011)

Paschal Donohoe: In checking this out, I took time to view Sinn Féin TV, which is embedded in the party's website. It contains some fantastic hits. On 7 February 2011, I watched Deputy Doherty say on the channel that the universal social charge brings in €420 million per year. That is exactly what Deputy Adams said a few moments ago on the floor of the House. That is not true. The reality is that this...
