- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Pre-legislative Scrutiny of the Companies (Protection of Employees' Rights in Liquidations) Bill 2021: Discussion (6 Jul 2022)
Louise O'Reilly: If Ms McElwee does not think there is an issue and that what happened to the Debenhams workers could not happen again or, if it did, that would be fine, that is one thing. I do not think we as legislators, should, stand over a gap in the legislation that allows workers to be treated in the way the Debenhams workers were treated. It behoves us, as legislators, to ensure we tighten up those...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Pre-legislative Scrutiny of the Companies (Protection of Employees' Rights in Liquidations) Bill 2021: Discussion (6 Jul 2022)
Louise O'Reilly: That underlines the need for this legislation. The legislation is needed in order to give the ability to shore up the position in circumstances where there is no one with whom to negotiate.
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)
Louise O'Reilly: On the first page of IBEC's submission, it states "these issues have now been resolved, and the pace has picked up considerably across Europe with the new court on track to open its doors in early 2023, with or without Ireland.". To a certain extent, while the subsequent part of the submission does not suggest so, the above suggests that the boat has sailed on this anyway and that things are...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)
Louise O'Reilly: It strikes me that we are very far behind on this. I do not know that we would be able to catch up but we can tease that out. Mr. Gaffney will be aware that there are well-accredited groups that have a view about that courts such as the UPC limit democratic freedoms and, crucially, interfere with the creation of things such as patent-free medicine. We have had a debate at this committee,...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)
Louise O'Reilly: On the second page of IBEC's submission, it says the "current system of country-by-country patent protection and litigation is ... expensive, time consuming and resource intensive". Will Mr. Gaffney give us an example of the kind of money being talked about when he says it is expensive, relative to a SME? Is it prohibitively expensive, to the point where people decide they cannot afford it...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)
Louise O'Reilly: Do we have any research on the number of companies that have just one or two patents which could scale the number up?
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Unified Patent Court: Discussion (13 Jul 2022)
Louise O'Reilly: Mr. Sweeney referred to one in 100 compared with one in ten. That is true across the European Union. Does he have any information relating to Ireland specifically, such as a survey of companies with certain proportions stating they would issue more patents if they could afford to defend them? The chances are that we are similar to the rest of Europe. What information are we relying on?
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: I thank the Chairman and our witnesses. This is pretty complicated, so we need to be sure we get it right. I am aware that there are substantial concerns, as expressed this morning. We had representatives of the Department here before the summer recess. Obviously, the representatives will have watched the proceedings. I asked for more information on what body would be a qualified entity....
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: The fact that we are still in the dark about this is somewhat concerning.
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: There is.
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: I thank Mr. Andrews. I have a specific question for him. Has he any designs or ideas for the representative action procedure that will be in place for injunctions and redress actions that can be brought by qualified entities when established? How would he see this working effectively? The legislation sets out how the procedures will work - that qualified entities can seek injunctions,...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: That is right, yes.
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: Secondary legislation is likely to be required. I am not trying to make the witness say something he does not want to say. I am trying to work it out myself.
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: Yes, I believe it would be required in all likelihood. Head 7, which concerns parties in a representative action, states that all costs will be borne by the qualified entity. There is an expense to bringing a case. Given that only nominal fees can be accepted by qualified entities, this creates a difficulty. The High Court is not cheap, as the witnesses noted in their submission. Dr....
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: Of course.
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: We are out of line with the rest of the European Union. Along with Greece, we are the only countries that do not allow for third-party funding, and there may be good reasons for that. Does Mr. Godfrey have a view on this?
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: That is where I have a genuine concern. We heard from the Irish Council for Civil Liberties, and it was very clear in saying we are out of line and that funding will be a real issue. You can talk all day about how the costs will be modest etc., but they are not. As it was point, it is time. If you work for free, you will never be idle, but people do not because they must pay their rent...
- Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Representative Actions for the Protection of the Collective Interests of Consumers Bill 2022: Discussion (14 Sep 2022)
Louise O'Reilly: And all of those things cost money. I thank the witnesses; my time is up.
- Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Living Wage (15 Sep 2022)
Louise O'Reilly: 1. To ask the Minister for Enterprise, Trade and Employment when workers can expect the progression towards a living wage to begin; the estimated timeframe for its delivery; if he will outline the benchmarking which will be used to calculate a living wage; and if he will make a statement on the matter.
