Questions on Promised Legislation (27 Jun 2018)

Pat Gallagher: Hold on, I said that. It is a matter for the courts.

Questions on Promised Legislation (27 Jun 2018)

Pat Gallagher: I thank the Deputy for his brevity and his example of what questions on promised legislation should be.

Ceisteanna - Questions (Resumed): Papal Visit (27 Jun 2018)

Pat Gallagher: If we are to adhere to the time, the Taoiseach only has three minutes to respond.

Topical Issue Matters (27 Jun 2018)

Pat Gallagher: I wish to advise the House of the following matters in respect of which notice has been given under Standing Order 29A and the name of the Member in each case: (1) Deputy James Browne - the need for the Minister for Health to outline what action is being taken to prevent assaults on health workers; (2) Deputy Sean Fleming - to discuss the electricity project at Coolnabacky, Ratheniska, County...

Ceisteanna - Questions (Resumed): Structured Dialogue Process (27 Jun 2018)

Pat Gallagher: Could I make a suggestion? The remaining six minutes would not do justice to the next group of questions. Leaders have been here since 12 noon and now have to make statements on the pre-European Council meeting. Perhaps we could move on to that now. Is that agreed? Agreed.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: I am familiar with Standing Order 68. When Deputy Catherine Murphy proposed this the last time, perhaps inadvertently, I immediately put it. On reflection, I think I was wrong because I believe the Minster has to be given an opportunity. It would close down debate. This is not all one sided debate. The Minister will have to be given an opportunity and if I accept this - and I may later...

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: What is the point of order?

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: The Minister might be prepared to speak, but-----

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: The Members wishing to speak have to be given the opportunity to speak. I am asking those Deputies to act reasonably and not to speak indefinitely, as they have done so far.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: If I may make a recommendation, if the Deputies are allowed to speak and want answers to their questions the questions should be posed. It is not necessary to deliver a full Second Stage speech. Will the Deputies agree to pose any questions they might have? I will then call on the Minister to answer the questions asked prior to this and any questions arising now.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: The Minister is suggesting that he will now answer the questions that were asked, and if there are further questions he will answer them at a later stage.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: It is not up to me. I cannot offer that proposal to Members if the Minister might not answer questions at a later stage. We have to make progress. Deputy Danny Healy-Rae is the next speaker and I ask him to remember to pose questions. I remind him that the amendment we are discussing reads: "Provided that the provisions of this subparagraph shall not apply in circumstances where a driving...

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: We understand the principle of the question now. The question is what happens to a person left at the side of the road in the circumstances outlined, whether it is in Sneem or Dungloe or elsewhere. We will look for an answer to that question. The Deputy may ask his next question.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: The Deputy has asked the same question twice.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: The same legislation will apply regardless of where one is leaving from or travelling to.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: The Deputy is asking a question he has already asked. The Minister has noted his question and will answer it.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: I am sure he will; he is anxious to answer.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: This amendment concerns circumstances where a driving test has not been supplied to an applicant within a period of six weeks. I can summarise the questions the Deputy is asking. Will parents be criminalised? Why was the Deputy not invited to Kerry by the Minister? Those are the questions. I do not know whether the Minister can answer them or not. They are simple questions. They do not...

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: The Deputy should make sure they are relevant questions.

Road Traffic (Amendment) Bill 2017: Report Stage (Resumed) (27 Jun 2018)

Pat Gallagher: The black box to which the Deputy is referring is not part of the amendment which is very clear. It reads "the provisions of this subparagraph shall not apply in circumstances where a driving test date has not been supplied to an applicant within a period of six weeks from the date of their application”. That is really what we are talking about.
