- Planning and Development (Housing) and Residential Tenancies Bill 2016: Report Stage (15 Dec 2016)
Bríd Smith: That was the whole point.
- Planning and Development (Housing) and Residential Tenancies Bill 2016: Report Stage (15 Dec 2016)
Bríd Smith: I never thought I would find myself agreeing with Deputy Micheál Martin about anything but I agree with him that it is freezing in here: I wish to quote from Article 43 of the Constitution of this country.1 1° The State acknowledges that man [not woman], in virtue of his [not her] rational being, has the natural right, antecedent to positive law, to the private ownership of...
- Planning and Development (Housing) and Residential Tenancies Bill 2016: Report Stage (15 Dec 2016)
Bríd Smith: While one Simon is creating a situation where people will still not be able to afford to pay their rent, the other Simon is trying to deal with a trolley crisis that saw 540 patients lying on trolleys last weekend.
- Planning and Development (Housing) and Residential Tenancies Bill 2016: Report Stage (15 Dec 2016)
Bríd Smith: The reason they are lying on trolleys is the same reason 90% of nurses voted today to go on strike. Nurses are emigrating because they cannot afford to live in this city or in Cork, Galway or Limerick. We have lost 5,500 fully trained nurses in the last few years because they cannot afford to live here and do not want to work in the extremely stressful conditions they are exposed to in this...
- Other Questions: Commissions of Inquiry (16 Dec 2016)
Bríd Smith: 15. To ask the Minister for Justice and Equality whether she will consider an independent public inquiry into the death of a person (details supplied) and the subsequent Garda actions; and if she will make a statement on the matter. [40437/16]
- Other Questions: Commissions of Inquiry (16 Dec 2016)
Bríd Smith: I am aware that this question has been brought before the Minister and previous Ministers with responsibility for justice many times in the Dáil. It relates to the case of the murder of Shane O'Farrell. I am raising it again. Those of us in the House will continue to raise it until we see a form of justice that is appropriate to the events that took place. We should have a discussion...
- Other Questions: Commissions of Inquiry (16 Dec 2016)
Bríd Smith: I feel rather inadequate standing in the Chamber before the Minister given that Shane's mother and sister are in the Gallery. They understand every detail of this case. In a more transparent and thorough-going democracy, for example, ancient Greece, they could have stood in front of the parliament and the nation to relay exactly the detail of the case and what happened. I wish to point...
- Other Questions: Commissions of Inquiry (16 Dec 2016)
Bríd Smith: The Minister may believe it is appropriate, but it is in fact wholly inappropriate not to open a public inquiry, not just because there is an investigation into the behaviour of gardaí but because there is no investigation into the behaviour of the Office of the Director of Public Prosecutions which allowed a case as serious as this to slip into the District Court as a minor offence....
- Other Questions: Commissions of Inquiry (16 Dec 2016)
Bríd Smith: Then how did the office let that file slip into the District Court?
- Other Questions: Commissions of Inquiry (16 Dec 2016)
Bríd Smith: This man was obviously above the law.
- Other Questions: Commissions of Inquiry (16 Dec 2016)
Bríd Smith: The Minister has oversight of the DPP.
- Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)
Bríd Smith: This may have already been clarified, but I need more clarity. If the Bill is passed today does it become law tomorrow?
- Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)
Bríd Smith: This relates to my question. What happens to tenants who have already been given notice by their landlords their rent will increase by 10% in January? What happens to this agreement? Will this law apply to these landlords or not? They have given notice but the rent has not effectively risen yet.
- Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)
Bríd Smith: It is important to clarify it because there is a cohort people who are expecting rent rises of 10% and beyond in January.
- Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)
Bríd Smith: On a point of order-----
- Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)
Bríd Smith: What I asked the Minister was if this legislation would apply-----
- Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)
Bríd Smith: I asked the Minister if it would apply if a landlord gave notice rather than entered negotiations with the tenant. If he gave notice of intent, does that mean he is covered by this legislation or not in the absence of any negotiations?
- Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)
Bríd Smith: It is a point of clarification. He did not answer the question.
- Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)
Bríd Smith: I want final clarity on this. Tenants who live in apartments in Cherry Orchard were given notice that their rent will increase by 10% in January. This does not mean they have had negotiations, but they have been given notice the rent will increase. It is not exactly a des res area but the rent is increasing by 10%. Will the Minister clarify for me whether the law will cover this and stop...
- Written Answers — Department of Justice and Equality: Direct Provision System (16 Dec 2016)
Bríd Smith: 23. To ask the Minister for Justice and Equality her plans to ensure that asylum seekers here will not face another Christmas in the direct provision system that has been described as a severe violation of human rights; and if she will make a statement on the matter. [40438/16]
