Topical Issue Debate: Company Closures (9 May 2017)

Pat Breen: I thank Deputies Eugene Murphy, Fitzmaurice and Calleary for raising this issue. It is an important issue that I have been following this issue closely since I was first informed about the announcement. First, as a rural Deputy, I recognise the impact that job losses can have on a town such as Ballaghaderreen and my thoughts are with the workers and the wider community affected by this...

Topical Issue Debate: Company Closures (9 May 2017)

Pat Breen: I thank Deputy Calleary for highlighting this issue. Ballaghaderreen has a population of 3,000 people. A loss of 38 jobs is significant in such a region. They are all local people as well. However, I must put on record the work that has been done through the Action Plan for Jobs. The first progress report was completed in December. The statistics are there to prove that the number of...

Written Answers — Department of Jobs, Enterprise and Innovation: Employment Rights (9 May 2017)

Pat Breen: I have no plans at this time to amend the provisions of the Organisation of Working Time Act to further elaborate on the definition of reasonable paid allowances, pay increases and or paid time off work with respect to Sunday premiums and supplemental provisions. The Deputy should note that there have been a number of Labour Court decisions that further elaborate on the...

Ireland and the Negotiations on the UK's Withdrawal from the EU: Statements (Resumed) (10 May 2017)

Pat Breen: I welcome the opportunity to make a statement on Brexit. I listened to the various Opposition speakers since 7.30 p.m. or so, and it is interesting to hear the various different opinions out there. I suppose nobody expected of the guidelines, following the negotiations and consultations that we have had over the past number of months with our colleagues in the European Union and the...

Companies (Amendment) Bill 2017 [Seanad]: Second Stage (11 May 2017)

Pat Breen: I move: "That the Bill be now read a Second Time”. A copy of my speech together with a short information note is being circulated to Members present in the House, which give will them additional useful information to what I will outline in my speech. I am pleased to bring the Companies (Amendment) Bill 2017 before the Dáil today. This is a very short Bill, with just two...

Companies (Amendment) Bill 2017 [Seanad]: Second Stage (11 May 2017)

Pat Breen: I thank Deputies Collins and Quinlivan for their and their party's support for this Bill. They certainly understand the urgency of it. I thank the Deputies as well for their contributions to this afternoon's debate. The Bill, as I said, may be technical, but its impact will be practical. That is the important thing about it. I believe it is an appropriate and measured response to the...

Companies (Amendment) Bill 2017 [Seanad]: Referral to Select Committee (11 May 2017)

Pat Breen: I move:That the Bill be referred to the Select Committee on Jobs, Enterprise and Innovation pursuant to Standing Orders 84A(3)(a) and 149(1) of the Standing Orders relative to Public Business.

Written Answers — Department of Jobs, Enterprise and Innovation: Legislative Programme (11 May 2017)

Pat Breen: On 2 May last, the Government approved draft legislative proposals as a response to the Programme for Government commitment to address the problems caused by the increased casualization of work and to strengthen the regulation of precarious work. The draft legislation was referred to the Office of the Attorney General on 4 May for priority drafting of a Bill. The proposals aim...

Ceisteanna - Questions (Resumed) - Priority Questions: Employment Rights (16 May 2017)

Pat Breen: On 2 May, the Government approved draft legislative proposals as a response to the programme for Government commitment to address the problems caused by the increased casualisation of work and to strengthen the regulation of precarious work. The draft legislation was referred to the Office of the Attorney General on 4 May for priority drafting. The proposals aim to address...

Ceisteanna - Questions (Resumed) - Priority Questions: Employment Rights (16 May 2017)

Pat Breen: This is a complex issue and it is not straightforward. This all originated from the UL study commissioned by the previous Government. This was an independent study which was not part of Government policy. It was, however, an important study because we based our talks on it. There was a consultation period during which we received 48 submissions. They were useful and we then had...

Ceisteanna - Questions (Resumed) - Priority Questions: Employment Rights (16 May 2017)

Pat Breen: There was a broad welcome for the proposals that were agreed. As the Deputy rightly pointed out, this is very complex. One is dealing with ICTU and Ibec, and this is where we had to draw a balance in the middle. We wanted to ensure that we protected low-paid workers. This is what the legislation was all about. It was not about anybody else. It was about vulnerable workers and low-paid...

Other Questions: Employment Rights (16 May 2017)

Pat Breen: I am not in a position to support the Banded Hours Contract Bill 2016 for the reasons my colleague, the Minister, Deputy Mitchell O'Connor, and myself explained during the Second Stage debate on that Bill last summer. In summary, the Bill as drafted is flawed, lacks balance and does not achieve its stated aim. Moreover, it would have very significant adverse consequences for employers'...

Other Questions: Employment Rights (16 May 2017)

Pat Breen: The Bill does not focus on low-paid vulnerable workers. Instead, it requires that all workers in every sector of the economy are given additional hours on request unless the employer can prove severe financial difficulties.

Other Questions: Employment Rights (16 May 2017)

Pat Breen: The Bill itself entirely misses the point of banded hours. I will tell the Deputy about what it does not do and what the Government's Bill does. Our Bill ensures that workers are better informed about their core terms of employment at a very early stage. That is important for any employee taking on a job. It strengthens the existing minimum compensation provisions for low-paid workers who...

Other Questions: Employment Rights (16 May 2017)

Pat Breen: I ask Deputy Gino Kenny to study our Bill when it is put together-----

Other Questions: Employment Rights (16 May 2017)

Pat Breen: I think he will be satisfied enough that we are going to ensure that workers are protected.
