Seanad: Address to Seanad Éireann by the Pope: Motion (19 Feb 2014)

Aideen Hayden: I ask that it be noted on the record that the question was carried unanimously.

Seanad: Order of Business (26 Feb 2014)

Aideen Hayden: I thank Senator David Norris for his comments. It is wonderful to see Dublin being defended in the way that sometimes areas west of the Shannon are defended. The north side of Dublin contains some of the poorest areas in the country. I wish to respond to the points made about people not turning up for hospital appointments. I will give a brief account of a personal story. In 2006, at the...

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Committee and Remaining Stages (26 Feb 2014)

Aideen Hayden: Will section 2 be deleted? I understood the amendment inserted a section.

Seanad: Order of Business (27 Feb 2014)

Aideen Hayden: A social welfare contract worth €50 million has been awarded to An Post, which will secure its future and the jobs therein.

Seanad: Order of Business (27 Feb 2014)

Aideen Hayden: I refer to the sale of the Irish Nationwide Building Society, INBS, loan book, which has been raised in the House on a number of occasions. I attended yesterday's meeting of the Joint Committee on Finance, Public Expenditure and Reform expecting to be reassured by the special liquidator and Department of Finance officials that those with INBS loans would be protected when the loan book is...

Seanad: Order of Business (27 Feb 2014)

Aideen Hayden: I have, but this is an important issue. Third, interest rates will be imposed by the lender. That is grand when we are dealing with Bank of Ireland, AIB and so on, but these mortgage holders will be dealing with organisations that are based outside the country and there will be no restriction on the interest rate they charge unless it is described as usury, and we all know what that means -...

Seanad: Order of Business (27 Feb 2014)

Aideen Hayden: Senator Mooney does not get out much.

Seanad: Order of Business (4 Mar 2014)

Aideen Hayden: At a time when we are discussing the loss of the Ukrainian people's sovereignty, it is ironic not to recognise the fact that this Government, through the Tánaiste and the Taoiseach, have regained the sovereignty of this country. We have exited a bailout programme and are creating jobs at a rate of 1,000 per week. It is ironic that Sinn Féin is discussing opinion polls when the...

Seanad: Order of Business (4 Mar 2014)

Aideen Hayden: Hear, hear.

Seanad: Economic Growth and Job Creation: Statements (4 Mar 2014)

Aideen Hayden: I welcome the Minister, Deputy Noonan, to the House. I know we have all asked for him to attend on a number of occasions. I was particularly keen to address some of the issues regarding banking and mortgage arrears with him. However, this is a more general discussion on economic growth and job creation. While we have certainly seen the headline figures mentioned in the Minister's speech,...

Seanad: Economic Growth and Job Creation: Statements (4 Mar 2014)

Aideen Hayden: The loan books will be owned by people who will have no regard whatsoever to the broad interest rates charged in this country.

Seanad: Order of Business (5 Mar 2014)

Aideen Hayden: I wish to make one point about the sale of the INBS loan book. I congratulate Deputy Michael McGrath for introducing legislation to try to protect the interests of mortgage holders who have mortgages with the Irish Nationwide Building Society. It is important to remember that the latter company was the original sub-prime lender in this country and there is a serious impairment on that loan...

Seanad: Child Protection: Motion (5 Mar 2014)

Aideen Hayden: I would like to thank all of the previous speakers for what have been excellent and thoughtful speeches. In particular, I congratulate the Minister on her speech. She has brought this debate to another level in looking more specifically at the whole issue of childhood and how it has evolved in the wider society to a point where we now believe and feel we need to protect children and give...

Seanad: Child Protection: Motion (5 Mar 2014)

Aideen Hayden: The line I would draw would exclude beautiful baby competitions.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Bi-annual Review 2013: Financial Services Ombudsman (5 Mar 2014)

Aideen Hayden: I wish to focus on the witness's description of his objectives. He said he provides an impartial alternative dispute resolution, ADR, process. I assume that in using the word "impartial" he means a fair dispute resolution process. I will frame my questions around that ADR process. The perspective I bring to it is that of somebody who has worked within another ADR process. The witness...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Bi-annual Review 2013: Financial Services Ombudsman (5 Mar 2014)

Aideen Hayden: The second part is somewhat related. It relates to the holding of oral hearings. I listened to the witness's response to Deputy Doherty. My concern is from a different perspective. I note the courts criticised the fact that oral hearings were not held. In that instance, it related to the complexity of the complaint. Many individuals who approach the ombudsman's office might have...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Bi-annual Review 2013: Financial Services Ombudsman (5 Mar 2014)

Aideen Hayden: The ombudsman gave a good explanation and I am much clearer on how he brings fairness to the process. If I understood the statistics correctly, the ombudsman found in favour of 202 applicants out of a total of 7,700, which seems to be a very low figure and implies one of two things. First, people are applying with absolutely no idea of what they are applying for and have no chance...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Bi-annual Review 2013: Financial Services Ombudsman (5 Mar 2014)

Aideen Hayden: Yes.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Bi-annual Review 2013: Financial Services Ombudsman (5 Mar 2014)

Aideen Hayden: I will repeat my question. Has the ombudsman made recommendations on the code of conduct on mortgage arrears to the Central Bank on foot of the cases that have come before him?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Bi-annual Review 2013: Financial Services Ombudsman (5 Mar 2014)

Aideen Hayden: One can easily fall out of the code of conduct on mortgage arrears by simply failing to respond to a piece of correspondence or whatever it happens to be. Does the ombudsman have evidence from the cases that have come before him that the CCMA has provided very weak protection for the consumer?
