Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Protected Disclosures Bill 2013: Committee Stage (14 May 2014)

Seán Fleming: I was actually going to raise this particular section with the Minister when we came to Schedule 4. Can he give us the specifics now of what this is about? If not, I would welcome them if they were to come through the committee well in advance of Report Stage. I do not know what is behind this, but I am troubled by the title of what I see in front of me.

Essentially, it is...

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Protected Disclosures Bill 2013: Committee Stage (14 May 2014)

Seán Fleming: It seeks to ensure the relevant section or subsection will "not apply to a communication that is a protected disclosure within the meaning of the Protected Disclosures Act 2013". I would like the Minister to explain that to us. Is he in some way eliminating some other lines of disclosure, or requirements for disclosure, under the Protections for Persons Reporting Child Abuse Act 1998? Is...

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Protected Disclosures Bill 2013: Committee Stage (14 May 2014)

Seán Fleming: The Minister is replacing those protections. I do not think he is superimposing this protection on top of them. This Bill clearly states that "this section does not apply". That section will not apply. It sounds as if the Minister feels this protection is a stronger one, so he is putting it in and the other one will not apply. I do not understand it.
